§ 93.106 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   EVENT. Any organized gathering for the purpose of entertainment, fund-raising or celebration activities, which is not sponsored by the town or any of its agencies. Events shall include, but not be restricted to, parades, festivals, fairs, dances, exhibitions or shows of any kind held on a public right-of-way or involving the use of town property or personnel. Activities not included in this definition shall be commemorative ceremonies, which are nonprofit in nature, church or civic functions not held on town property, or sidewalk sales or outdoor sales of merchandise held by merchants or residents on private property.
   FESTIVAL AREA. The area of the town designated by a permit applicant and approved in the permit issued by the Board of Commissioners pursuant to § 93.107. The permit may delineate the festival area by attachment of a map, by setting out the streets that border the festival area or in any other manner reasonably calculated to accurately define the festival area.
   NONPROFIT. An incorporated organization chartered for other than profit-making activities. Most such organizations are engaged in charitable, educational or other civic or humanitarian activities although they are not restricted to such activities.
   PERMITTEE. A person, corporation, partnership, unincorporated association or other entity who is issued a permit for any event pursuant to § 93.107.
   SATELLITE EVENT. Any function or display which operates independently from the event or festival but which takes place in conjunction with the event or festival.
   SEXUALLY EXPLICIT MATERIAL. This definition includes SPECIFIED ANATOMICAL AREAS and SPECIFIED SEXUAL ACTIVITIES.
      (1)   SPECIFIED ANATOMICAL AREAS refers to less than completely and opaquely covered human genitals or pubic region, buttocks and female breasts below a point immediately above the top of the areola; and human male genitals, even if completely covered.
      (2)   SPECIFIED SEXUAL ACTIVITIES refers to human genitals in a state of sexual stimulation or arousal; acts of human masturbation, sexual intercourse or sodomy; and fondling or other erotic touching of human genitals or pubic region, buttocks or female breasts.
