§ 52.099 METHOD OF DETERMINING SURCHARGES AND RATES.
   (A)   Surcharges.
      (1)   Mass Emission Rate, MER ( ) = MG x 8.34, where:
         (a)   MER is the mass emission rate in pounds of a particular constituent.
         (b)   MG is the millions of gallons of wastewater discharged.
         (c)   C is the concentration in mg/l of the particular constituent being charged for (for example: BOD, SS, ammonia nitrogen, COD and the like), and 8.34 is equal to the number of pounds/one gallon of water.
      (2)   The amount of the charge in dollars will be calculated as follows: Ao = R x MER ( ), where:
         (a)   Ao is equal to the amount of the charge in dollars.
         (b)   R is equal to the rate of charge per pound of constituent.
         (c)   MER ( ) is equal to the pounds of a constituent.
   (B)   Rates.
      (1)   The town shall annually review the actual cost of operation and maintenance of the town’s wastewater collection system and wastewater transmission and treatment charges, adjust the surcharge rates and the volume user charge rate (per 1,000 gallons) to reflect the true cost of constituent collection and treatment. The adjustments, if any, will become effective following the first day of each new fiscal year. The Board of Commissioners may review these rates and adjust them accordingly at any time it deems adjustments are in the best interest of the town.
      (2)   In addition, the town will establish connection charges, or tap-on charges, for various size service lines and shall review and adjust these charges annually. Also, the town may establish, review and change from time to time, other special service charges concerning the sewer system.
