§ 52.047 INDUSTRIAL USERS; SPECIAL REQUIREMENTS.
   (A)   The town shall require each industrial user to construct, operate and maintain waste treatment facilities necessary to pretreat its industrial wastewater, to produce an effluent which conforms in quality with the effluent limitations established for each class of industrial users by the U.S. EPA and state regulatory agencies, prior to discharging the wastewater into town sewers.
   (B)   Industries shall pretreat industrial wastewater in accordance with National Pretreatment Standards for the various industrial classifications as promulgated by EPA under § 403 of the Act. Any substances which result in interference with the town’s treatment processes shall be specifically prohibited.
   (C)   The town, without limitations by other sections of this chapter, may authorize any person to discharge industrial waste into the collection system without requiring pretreatment under the following conditions:
      (1)   The industrial waste contains no pollutants which cannot be removed in treatment processes provided to remove pollutants in wastewater introduced from nonindustrial sources;
      (2)   When it is proven that treating combined untreated industrial wastewater and nonindustrial wastewater is more cost effective than requiring industries to pretreat their waste.
   (D)   The town may prohibit entry of particular industrial wastes into sanitary sewer whenever the action is necessary to prevent damage to the system or to determine the effects of the wastes on the wastewater treatment system.
   (E)   Any person discharging industrial wastes into the town’s wastewater collection system shall construct and maintain a suitable control manhole, downstream from any treatment, storage or other approved works, to facilitate observation, measurements and sampling of all wastes including domestic wastewater, from the industry. The control manhole shall be constructed at a suitable and satisfactory location and built in a manner approved by the town. Where a storage tank is not required, the control manhole shall be equipped with a permanent type of volume-measuring device such as a flume, nozzle or other suitable devices as may be approved by the town. The manhole shall be installed at the expense of the person discharging the wastes and shall be maintained by him so as to be safe, accessible and in proper operating condition at all times. Ready, 24-hour per day access to the control manholes shall be provided to the town.
   (F)   Plans for the construction of the control manhole and flow measuring devices shall be approved by the town prior to the beginning of construction.
