§ 52.018 CONNECTIONS REQUIRED WITHIN TIME LIMIT.
   (A)   All property owners having property located within 200 feet of a sewer line, if the property is occupied, shall install sanitary toilets and make sewer connections within 30 days after notice. Provided that approved septic tanks may be used where sewer connections are impractical; and provided further that no private septic tank disposal system may be installed until a permit has been obtained from the County Health Department.
   (B)   Notwithstanding the provisions of division (A) of this section, the following shall apply with respect to connections to sewer lines in areas annexed into the town by any means other than by petition for voluntary annexation.
      (1)   If the annexed property is served or to be served by a gravity sanitary sewer line, then the owner of the property shall connect to the gravity sanitary sewer line within one year after the date the sanitary sewer becomes available to that property, if the property is developed as of the effective date of the annexation. If the annexed property is not developed as of the effective date of annexation, then the owner of the property shall connect to the gravity sanitary sewer line when the property is developed.
      (2)   If the annexed property is served or to be served by a pressurized sanitary sewer line, then the owner of the property shall connect to the pressurized sanitary sewer line within five years after the effective date of annexation, if the property is developed as of the effective date of the annexation. If the annexed property is not developed as of the effective date of annexation, then the owner of the property shall connect to the pressurized sanitary sewer line when the property is developed.
