§ 50.21 SCATTERING REFUSE PROHIBITED.
   (A)   It shall be unlawful for any person to do the following:
      (1)   Scatter refuse about or litter any public or private street or area or place;
      (2)   Cast, throw, place, sweep or deposit anywhere within the town, any refuse or trash in such a manner that it may be carried or deposited by the elements upon any street, sidewalk, alley, sewer, parkway or other public place or into any occupied or unoccupied premises.
   (B)   It shall be unlawful for any vehicle transporting loose materials within the town to transport same without suitable covers. This section shall not apply to the transportation of poultry, livestock, tobacco and silage or other feed grain used in the feeding of poultry or livestock.

§ 50.22 COMMERCIAL ESTABLISHMENTS.
   (A)   All commercial establishments shall store their refuse in receptacles or containers as specified herein so as to eliminate wind-driven debris and unsightly litter in and about their establishments. Approved methods of containerization include refuse receptacles, bulk containers and detachable containers. The number and type of containers necessary for each commercial establishment shall be as required to maintain a clean, neat, sanitary premises as directed by the Department of Public Works. Spillage and overflow shall be immediately cleaned up when and as it occurs by the establishment. Equipment and other personal property located or stored outdoors shall be situated to prevent water from accumulating therein.
   (B)   Commercial establishments will be allowed to use the 96 gallon receptacles under the following guidelines:
      (1)   The property does not have room available for a commercial dumpster;
      (2)   The property does not have room for a commercial front end truck to safely access a dumpster;
      (3)   The property’s generated waste is similar in size and material to residential waste, no food waste, hazardous waste, or construction debris;
      (4)   Solid waste and recycle receptacles shall be secured in an enclosed area at the rear of property.
      (5)   The Public Works Director shall determine the need for size and number of any such receptacle according to commonly accepted standards, based on the quantity of refuse and the schedule of collection. The solid waste collector shall pick up no more than three solid waste receptacles and three recycling receptacles per dwelling or commercial business per collection day. Any dwelling unit or commercial business generating more than can be contained in three solid waste receptacles or three recycling receptacles between collection days shall use bulk containers.

§ 50.23 LOADING AND UNLOADING AREAS.
   All loading and unloading areas shall be provided with refuse receptacles for loose debris, paper, packaging materials and other trash. The number of containers necessary for each area shall be as required to maintain a clean, neat, and sanitary premises as directed by the Department of Public Works or its contractor.

§ 50.24 INSPECTION AND REPLACEMENT OF RECEPTACLES.
   All refuse receptacles shall be inspected as to their sanitary condition, and if and when found in an unsanitary condition or deteriorated condition, the Public Works Department shall furnish the owner of the cans with a notice to correct the condition. It shall be the duty of every person owning, controlling, managing, operating, policing, renting or occupying any premises where garbage and/or trash accumulates, to replace within ten days after receipt of a notice issued by the town, acting through its duly authorized officials any receptacles that have deteriorated or that are found in an unsanitary condition.

§ 50.25 COLLECTORS TO USE REASONABLE CARE.
   Solid waste and recycling collectors shall exercise reasonable care in the handling of receptacles and shall not willfully break, deface or injure the same.

§ 50.26 CURBSIDE PICKUP.
   All solid waste, recycling, or other refuse shall be placed on the curbside by the property owner for collection by the collector, except businesses and apartment complexes, where refuse shall be placed in a duly designated, easily accessible area for pickup. The curbside area shall be in front of the property and at least three feet from other objects, such as mailboxes, vehicles, and utilities poles. Containers shall not be placed at the curb any earlier than 5.00 p.m. the night before the scheduled collection day, and shall be removed from the curb no later than 6:00 a.m. the day following collection. All loose refuse (for example, leaves, grass clippings, and the like) shall be placed in outdoor, leaf-and-lawn-style paper bags during all months of the year. Tree limbs shall be no larger than six inches in diameter, and in lengths not to exceed eight feet. Yard waste generated by a professional landscaping service, tree service, lot clearing, or by a voluntary removal of trees will not be collected or disposed of by the town.

§ 50.27 BURNING OR BURYING GARBAGE, SOLID WASTE, RECYCLING OR REFUSE.
   It shall be unlawful to burn or set fire to any garbage, solid waste, recycling, or refuse for the purpose of disposal, unless a permit therefor has been granted by the fire chief. In addition, it shall be unlawful to bury any refuse for the purpose of disposal.
