§ 50.02 DEFINITIONS.
   For the purpose of this chapter, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
   BULK CONTAINER.  A container that can be picked up and emptied mechanically.
   BUSINESS TRASH. Any waste accumulation of dust, paper, cardboard, excelsior, rags or other
accumulations which are usually attendant to the operation of stores, offices and similar businesses.
   COMMERCIAL ESTABLISHMENT. Any retail, manufacturing, wholesale, institutional, religious, governmental or other non-residential establishment at which garbage or trash may be generated.
   CONSTRUCTION DEBRIS. Any discarded material such as lumber, brick, plastic, aluminum, styrofoam, plaster, paper, sheet rock, vinyl or other substances accumulated as a result of repairs or additions to existing structures or buildings, construction of new structures or buildings or demolition of existing structures or buildings, including but not limited to excavated earth, stones, brick, plaster, lumber, concrete, shingles, insulation and waste parts generated by installations and replacements of structures and facilities.
   CUSTOMER. Any person, corporation, firm or other entity which generates, collects or otherwise causes or allows to be accumulated any kind of construction debris, business trash, garbage, hazardous refuse, household trash, industrial waste, litter, refuse, solid waste, yard trash or any other kind of trash or rubbish upon property served by the garbage collector of the town.
   DETACHABLE CONTAINER. A unit which is used for collecting, storing and transporting construction debris, commercial trash, industrial waste, hazardous refuse, refuse or yard trash. The distinguishing feature of the detachable container is that it is picked up by a specially equipped truck and becomes an integral part of the truck for transporting the waste materials to the disposal site. Commonly known as a “Green box.”
   GARBAGE. The by-product of animal or vegetable foodstuffs resulting from the handling, preparation, cooking and consumption of food which is subject to decay, and which generates offensive odors, and serves as breeding material for pests.
   GARBAGE COLLECTOR. The Town of Swansboro or any person, corporation, firm or other entity duly appointed, contracted or otherwise designated by the town as responsible for the collection and disposition of construction debris, business trash, garbage, hazardous refuse, household trash, industrial waste, litter, refuse, solid waste, yard trash or any other kind of trash or rubbish pursuant to the provisions of this chapter.
   HAZARDOUS REFUSE. Materials such as poisons, acids, caustics, chemicals, infected materials, offal, fecal matter and explosives.
   HOUSEHOLD TRASH. Every waste accumulation of paper, sweepings, dust, rags, bottles, cans or other matter of any kind, other than garbage, which is usually attendant to housekeeping.
   INDUSTRIAL WASTE. All waste, including solids, semi-solids, sludges and liquids created by factories, processing plants or other manufacturing enterprises.
   LITTER. Any discarded, used, unconsumed, noncontainerized substance or waste. Litter may include, but is not limited to any garbage, trash, refuse, debris, rubbish, grass clippings or other lawn or garden waste, newspaper, magazines, glass, metal, plastics, plastic or paper containers or other packaging, construction debris, motor vehicles parts, furniture, oil, carcass of a dead animal, cloth, any nauseous or offensive matter of any kind, any object likely to injure any person or create a traffic hazard or anything else of an unsightly nature, which has been declared, abandoned or otherwise disposed of improperly.
   LOADING AND UNLOADING AREA. Any stream, river, or lakeside land dock or ramp, space or area used by any moving vehicle for the purpose of loading/unloading, commodities and persons.
   PERSON. Any individual, firm, company, partnership, corporation or association.
   PORTABLE PACKING UNIT. A metal container that contains a compacting mechanism and an internal or external power unit.
   PUTOUT. Solid waste which has been placed by a household, commercial or business establishment for the purpose of being picked up by an appropriate collection agency or for pickup and delivery to an authorized disposal area by others.
   REFUSE. Solid waste accumulations consisting of garbage, household trash, commercial and/or business trash as herein defined.
   REFUSE RECEPTACLE. A corrosion resistant metal or plastic container, for refuse, of substantial construction, with tight fitting lid, and provided with wheels and/or handle sufficient for safe and convenient handling. The receptacles shall be kept in serviceable condition at all times.
   RUBBISH. Any waste material not otherwise defined in this section.
   SOLID WASTE. Useless, unwanted or discarded material with insufficient liquid content to be free flowing.
   WEEK. That period of time between one Sunday and the following Sunday.
   YARD TRASH. Waste accumulation of lawn grass or shrubbery or vine cuttings or clippings and dry leaf rakings, free of dirt, rocks, large branches, and bulky or noncombustible material.
