925.04 COUNTY SUPPLEMENTAL LIMITATIONS.
   (a)   The Director is authorized to establish local limits pursuant to 40 C.F.R. Section 403.5 (c).
   (b)   No user shall discharge or cause to be discharged into the sewerage system pollutants at levels above the maximum background concentration, unless:
      (1)    The user is defined as a significant industrial user by the Director; and
      (2)    The user is issued a wastewater discharge permit by the County that allows the discharge of pollutants at limits specified in the permit.
   (c)   No significant industrial user shall discharge wastewater to the sewerage system exceeding the pollutant concentration and/or mass loading limits specified in the User's wastewater discharge permit issued by the County.
   (d)   The Director shall develop, evaluate, and establish, as required, allowable concentration limits, allowable pollutant mass loadings, allowable industrial pollutant mass loadings and maximum background concentration limits of pollutants for each wastewater treatment plant to which the County sewer system discharges. The Director will provide the public with adequate notice of changes in local industrial wastewater mass loadings and will provide responses to interested parties before said changes take effect.
   (e)   Where, by agreement with other governmental units, the County conveys wastewater for treatment at POTWs not owned and operated by the County, the Director may use local supplemental limitations developed for the specific wastewater treatment plant or limitations as stipulated in the appropriate governmental agreement(s).
   (f)   The Director shall maintain a table of maximum background pollutant concentrations and local industrial pollutant discharge limits for each wastewater treatment plant and report his findings on supplemental limitations at least annually to County Council. Local discharge limits shall be re-evaluated by the Director when new or revised NPDES permit limits are issued by the OEPA.
   (g)    The Director may establish best management practices through the revision of this Chapter or in individual wastewater discharge permits, to implement local limits and the requirements of Section 921.05 of this Chapter.
