(a) All premises using County water shall be equipped with a water meter except that water service may be supplied at a flat rate until a meter is installed. All County water users shall be charged for water and fire protection service in accordance with the methodology contained in this chapter.

(b) Effective January 1, 1994 or the Effective Date of this Section, Whichever is Later. Users supplied with County water service shall pay the following monthly fees:

Each meter shall be considered a separate billing unit in applying these rates. Unmetered water use by single-family residences shall be charged an estimated usage of 9.33 hundred cubic feet (HCF) per month.

(c) Adjustments or Lowering.
(1) The Department of Sanitary Sewer Services, with the approval of County Council, is hereby authorized to adjust water rates necessary to offset additional purchased water costs from the City of Akron in years 1995 through 1998.
(2) The Department of Sanitary Sewer Services is hereby directed to lower the water rates to the extent actual capital and operating costs are determined to be less than the anticipated costs associated with the proposed $3.5 million Green water system improvement. The Department of Sanitary Sewer Services is further directed to lower water rates to the extent necessary if the City of Green does not sign a water contract with the County by December 31, 1994.

(d) Fixed Income Citizen/Disabled Citizen Discount Program.
(1) The Summit County Fixed Income Citizen/Disabled Citizen Discount Program ("Discount Program") shall apply only to qualified residential customers. A discount of ten percent (10%) shall be deducted from the water bill for qualified residential customers.
(2) A "qualified residential customer" shall be defined as an individual who:
A. Receives water and/or sewer services from Summit County;
B. Owns and occupies a "homestead", as defined in Ohio R.C. 323.151;
C. Has a total income which does not exceed three thousand dollars ($3,000) more than the maximum qualifying total income level for the Homestead Exemption;
D. Has, as their primary source of total income, retirement pensions and/or survivor benefits from a former employer, labor union, or Federal, State or other governmental agency; or, disability income; or, receipts from annuities or insurance; or, income from IRA plans; or, income from KEOGH plans;
E. Qualifies for a homestead exemption as a permanently and totally disabled person as set forth in Ohio R.C. 323.151 and 323.153.
(3) The term "total income", as used in the Discount Program, means the same as defined in Ohio R.C. 323.151.
