The fire chief of the township in which the business is to be located may issue a permit to sell fireworks at wholesale or retail on a form prescribed by the County Sheriff to any person who makes application for a permit pursuant to Section 551.01 if all of the following apply:
(a) The applicant has paid a fee of twenty-five dollars ($25.00) to the clerk of the township;
(b) The applicant intends to sell and store the fireworks in accordance with Ohio R.C. 3743.05 and 3743.30, as amended; and
(c) The applicant has not been convicted of a violation of the provisions of this chapter or of Ohio R.C. 3743.99.
