(A) For every subdivision within the territorial jurisdiction established by § 151.004, a preliminary plat shall be submitted for review by the Planning Board and approval by the Village Council before any permits may be issued or before any construction or installation of improvements may begin.
(B) Six copies of the preliminary plat shall be submitted to the Subdivision Administrator at least ten days prior to the Planning Board meeting at which the preliminary plat is to be considered. This time period may be waived at the discretion of the Planning Board.
(1) Contents required. The preliminary plat shall include all information and supporting documentation required on the preliminary plat checklist found in § 151.120.
(2) Fees required. The subdivider shall pay $500 for preliminary plat approval, plus $50 per lot in the subdivision. The preliminary plat approval fee shall be paid at the time the preliminary plat is presented to the Planning Board. The subdivider shall pay $300 for the final plat approval. The $300 shall be paid at the time the final plat is submitted to the Planning Board.
(3) Review by other agencies. After having received the preliminary plat from the subdivider, the Subdivision Administrator shall make available copies of the preliminary plat and any accompanying material to other officials and agencies concerned with new development, including, but not limited to:
(a) Village Public Works Director, regarding roads and drainage;
(b) Carolina Water Service Company, regarding the water system and public sewerage system;
(c) County Health Department and/or other appropriate departments and agencies regarding septic systems; and
(d) The appropriate local or state agency responsible for the review and approval of sedimentation and erosion control plans.
(4) Proof of approval. Where this chapter requires proof of approval from state or local agencies, the following certificates, substantially consistent in form to those shown in § 151.122, shall be received by the Planning Board prior to its first consideration of any preliminary plat:
(a) A certificate signed by the Village Public Works Director, stipulating that the plans for any proposed street system conforms to the design requirements of the department and this chapter;
(b) A certificate(s) signed by the appropriate state and/or local official(s), stipulating that the plans for proposed water supply and/or sewage disposal systems conform with all design requirements; and
(c) A certificate signed by the appropriate state or local official stipulating that the soil erosion and sedimentation control plan for the proposed development is approved.
(5) Review procedure; Planning Board.
(a) The Planning Board shall review the preliminary plat at its next regularly scheduled meeting pursuant to the requirements in this section. The Planning Board shall, in writing, recommend approval, conditional approval, or disapproval, within 45 days of the Board’s first consideration of the plat.
(b) If the Planning Board recommends approval of the preliminary plat, it shall retain three copies of the plat for its records, and transmit three copies to the Village Council with the Board’s recommendation.
(c) If the Planning Board recommends conditional approval of the preliminary plat, it shall retain two copies for its records, transmit three copies to the Village Council with the Board’s recommendations, and return one copy to the subdivider with the Board’s recommendations.
(d) If the Planning Board recommends conditional approval of the preliminary plat, it shall retain two copies for its records, transmit three copies to the Village Council with the Board’s recommendations, and return one copy to the subdivider with the Board’s recommendations.
(e) If the Planning Board recommends disapproval of the preliminary plat, it shall retain
two copies for its records, transmit three copies to the Village Council with the Board’s recommendations, and return one copy to the subdivider with the Board’s recommendations. If the preliminary plat is disapproved, the subdivider may make the recommended changes and submit a revised preliminary plat, or appeal the decision to the Village Council.
(6) Review procedure; Village Council.
(a) Upon the Planning Board’s recommendation of approval of the preliminary plat, or conditional approval with modifications to bring the plat into compliance, or upon the subdivider’s appeal of the Planning Board’s decision, the Village Council shall review and approve or disapprove the preliminary plat.
(b) Subject to the Village Council’s approval of the preliminary plat, such approval shall be shown on each copy of the plat by the following signed certificate:

(c) One copy of the plat shall be retained by the Village Council, one copy shall be transmitted to the Planning Board, and one copy shall be returned to the subdivider.
(d) If the Village Council approves the preliminary plat with conditions, the certificate of approval shown above shall be shown on each copy of the plat with a reference to the conditions required by the Village Council. One copy of the plat along with the conditions shall be retained by the Village Council, one copy of the plat along with conditions shall be transmitted to the Planning Board, and one copy of the plat with the conditions shall be returned to the subdivider.
(e) If the Village Council disapproves the preliminary plat, the reasons for such disapproval shall be specified in writing. One copy of the plat and the reasons for disapproval shall be retained by the Village Council, one copy of the plat and reasons for disapproval shall be transmitted to the Planning Board, and one copy of the plat and reasons for disapproval shall be returned to the subdivider. If the preliminary plat is disapproved, the subdivider may make such changes as will bring the plat into compliance and resubmit the same for reconsideration by the Planning Board and the Village Council.
(7) Validity of approval. Approval of the preliminary plat shall be valid for one year unless a written extension is granted by the Village Council on or before the one year anniversary of said approval. If the final plat is not submitted for approval within said one-year period, or any period of extension, the said approval of the preliminary plat shall be null and void.
