12-1-3: APPLICABILITY AND COMPLIANCE:
All subdivisions, including planned unit developments, hereafter planned within the incorporated limits of the village and within the area of the village's planning jurisdiction as established by statute, shall, in all respects, be in full compliance with this title. The provisions of this title are hereby adopted pursuant to the powers granted to the village in 65 Illinois Compiled Statutes 5/11-12-5 as follows:
   A.   Subdivision Of Land: After the adoption of these subdivision regulations, no "subdivision" of land as defined within this title shall take place without complying with the provisions of this title and any other provisions of this code relating to the "subdivision" of land as herein defined.
   B.   Sale Or Lease Of Land: No lot, tract or parcel of land within any proposed subdivision shall be offered for sale or lease, contracted for sale or lease, nor shall any sale or lease be consummated, nor shall an option for sale or lease be given until a subdivision plat has been reviewed and officially approved by the village board and recorded with the recorder of deeds, Kane County, Illinois, in accordance with the procedures set forth in this title.    C.   Improvements Of Land: No improvements, such as sidewalks, water supply, storm water drainage, sewage facilities, gas service, electric service or lighting, grading, paving or surfacing of any street, shall be made within any proposed subdivision by any owner or owners or his or their agent, or by any utility whether publicly or privately owned or operated, at the request of such owner or owners or by his or their agent until the plans and plat have been reviewed by the village engineer, approved by the village board, and said plat has been recorded in the office of the Kane County recorder in accordance with the procedures set forth in this title. At the village's discretion, site improvements may be constructed prior to the recording of the final plat, but not prior to approval of the preliminary plat, if a site development permit is issued by the village.    D.   Development Of Land In Stages: Where a tract of land is proposed to be subdivided in several stages over a period of years, the subdivider shall have the entire subdivision designed and presented to the village for final plan approval. The final plans shall include a phasing plan, showing the boundaries of the proposed phases. Phase boundaries shall be located in accordance with the requirements of section 12-4-5-3 of this title. Phases approved but for which construction has not begun within four (4) years of final plan approval may be subject to revisions necessitated by changes to this title or other ordinances or policies of the Village which impact the subdivision. Such revisions shall be submitted to the Planning Commission/Zoning Board of Appeals for review and to the Board of Trustees for approval. (Ord. 604, 9-8-1994; amd. Ord. 2018-03-20B, 3-20-2018)
