A. Employment:
1. Qualifications And Standards: Any person of good character who meets the qualifications and standards for being a police officer as prescribed by state statute, village ordinance and rules of the department as prescribed from time to time by the village administrator, chief of police or board of trustees, may be employed as a police officer for the village. Such standards and employment shall be made in accordance with the provisions of the board of police and fire commissioners act, 65 Illinois Compiled Statutes 5/10-2.1-1 et seq.
2. Discrimination: No applicant for a position with the police department of the village shall be excluded by reason of race, creed, color, religion, sex or station in life. The police department shall be an equal opportunity employer and, as such, shall comply with applicable state and federal statutes and regulations pertaining to employment practices.
3. Probationary Period: All persons employed as police officers shall be probationary employees for a period of one year from the date of their employment. The probationary period may be extended up to an additional one hundred eighty (180) days at the discretion of the chief of police. A police officer may be discharged without cause during said probationary period. Thereafter, a police officer, other than the chief of police may be discharged in accordance with the provisions of section 5-1-7 of this chapter.
4. Part Time Police Employment: The village of Sugar Grove may employ part time police officers from time to time as they deem necessary.
5. Duties: A part time police officer shall have all the responsibilities of a full time police officer and such specific duties as delineated in the policy manual of the Sugar Grove police department, but the number of hours a part time officer may work within a calendar year is restricted. Part time police officers shall not be assigned to supervise or direct full time police officers. Part time police officers shall be trained in accordance with the Illinois police training act 1 and the rules and requirements of the ILETSB.
6. Hiring Standards: Any person employed as a part time police officer must meet the following standards:
a. Be of good moral character, of temperate habits, of sound health, and physically and mentally able to perform assigned duties.
b. Be at least twenty one (21) years of age.
c. Pass a medical examination.
d. Possess a high school diploma or GED certificate.
e. Possess a valid state of Illinois driver's license.
f. Possess no prior felony convictions.
g. Any individual who has served in the U.S. military must have been honorably discharged.
7. Discipline: Part time officers shall be under the disciplinary jurisdiction of the chief of police. Part time police officers serve at the discretion of the village authorities, shall not have any property rights in said employment, and may be removed by the village authorities at any time. Part time police officers shall comply with all applicable rules and policies issued by the police department. (Ord. 2012-08-21A, 8-21-2012)
B. Authority: The chief of police and all officers of the department shall have the power and authority of a constable at common law and such other powers as granted to municipal police officers under the statutes of the state and as set forth in the ordinances of the village.
C. Duties:
1. Enforcement Of Law: It shall be the duty of the chief of police and police officers of the department to enforce all of the ordinances of the village, state and federal statutes applicable therein and to preserve order, prevent violation of the law and to arrest violators thereof.
2. Testimony As Witness: Every police officer and member of the department shall appear as a witness whenever necessary for the prosecution of any violation of a village ordinance, state or federal statute. All witness fees received by an officer for testimony shall be delivered to the village treasurer.
3. Service Of Process: The chief of police and police officers of the department shall serve process upon proper application or request therefor.
D. Chain Of Command: The corporate authorities may provide for a chain of command. (Ord. 2008-07-15B, 7-15-2008)
E. Salaries: Salaries and wages of the police officers and members of the police department shall be as established and determined from time to time by the board of trustees.
F. Civilian Employees: The village administrator may employ civilians who are not officers of police to perform duties of a nonenforcement nature for the police department when funds for such purposes are budgeted by the board of trustees. (Ord. 2004-01-20B, 1-20-2004)
G. Acceptance Of Rules: Acceptance of a position with the police department shall constitute acceptance of and shall be an agreement to abide by the rules and regulations as may from time to time be adopted. (Ord. 589, 9-13-1993)
H. Emergency Lights In Personal Vehicles; Authorization: The village, as a competent authority pursuant to 625 Illinois Compiled Statutes 5/12-215(a)(2), hereby authorizes any sworn officer of the village police department to possess and operate, in accordance with state statute, emergency lights in their personal vehicles. Each officer shall only be permitted to utilize said emergency lights in one personal vehicle, of his or her own, at a time. Each officer so authorized shall exercise reasonable control over such lights so as to assure that only the sworn officer has the ability to use said emergency lights, and no other person with access to such personal vehicles may utilize said emergency lights. The chief of police is hereby authorized to enact such additional policies, conditions or limitations on the use of said lights as he/she deems necessary to carry out the purposes of this subsection.
