935.03 DEFINITIONS.
   For the purposes of this Chapter, the following words and phrases shall have the meanings indicated:
   (a)   “Assessment Roll” means the official listing of assessments of real property maintained by the State Department of Assessments and Taxation of Ohio or Mahoning County.
   (b)   “Base Rate” means the monthly Storm Water Management Fee charge.
   (c)   “Base Unit” a single family residential property in the City or 3,500 sq. ft. of impervious surface and area.
   (d)   “Board” means the Storm Water Management Board for the City of Struthers. In lieu of a Storm Water Management Board the Council of the City of Struthers shall act as the Board.
   (e)   “Safety Service Director” means the City of Struthers Safety Service Director, or his/her designee.
   (f)   “Developed Property” means real property which has been altered from its natural state by the addition of any improvements such as buildings, structures, or other impervious area.
   (g)   “Fee or Storm Water Management Fee” means the charge established under this chapter and levied on parcels or pieces of real property to fund the costs of storm water management and of operating, maintaining, and improving the storm water system in the City.
   (h)   “Fiscal Year” means January 1 of a calendar year to December 31 of the calendar year, both inclusive.
   (i)   “Impervious Surface Area” means the number of square feet of horizontal surface covered by buildings and other impervious surfaces. All building measurements shall be made between exterior faces of walls, foundations, columns or other means of support or enclosure.
   (j)   “Impervious Surface” means a surface area which is compacted or covered with material that is resistant to infiltration by water, including, but not limited to, most conventionally surfaced streets, roofs, sidewalks, patios, driveways, parking lots, and any other oiled, graveled, graded, compacted, or other surface which impedes the natural infiltration of surface water.
   (k)   “Industrial properties” mean properties used for the manufacturing, warehousing and distribution activities.
   (l)   “Institutional properties” include schools, churches, nursing homes, residential care facilities, cultural facilities and libraries.   
   (m)   “Multi-Family Dwelling” means a building with more that two dwelling units.
   (n)   “Multi-unit Commercial” means properties used for multiple commercial activities that share common parking such as plazas, business office complexes for which there is one responsible party.
   (o)   “Other Developed Property” means developed property other than single-family residential property. Such property shall include, but not be limited to, multi- family dwellings, commercial properties, industrial properties, parking lots, hospitals, schools, recreational and cultural facilities, hotels, offices, and churches.
   (p)   “Property Owner” means the property owner of record as listed in the State or County assessment roll. A property owner includes any individual, corporation, firm, partnership, or group of individuals acting as a unit, and any trustee, receiver, or personal representative.
   (q)   “Responsible Party” means the property owner or individual, proprietor, corporation who, through lease or ownership, is obligated to pay said Fee. However, ultimate responsibility for said Fee shall be the property owner as defined herein.
   (r)   “Single Family Residential Property” means a developed property which serves as the primary purpose of providing a permanent dwelling unit and which is classified as residential in the State/County assessment rolls. A single family detached dwelling or a townhouse containing an accessory apartment or second dwelling unit is included in this definition.
   (s)   “Single unit commercial” means any developed property used for a single commercial purpose or professional service.
   (t)   “Storm Water Management Fund” means the Fund created to operate, maintain, and improve the City of Struthers storm water system.
   (u)   “Storm Water Management” means the planning, design, construction, regulation, improvement, repair, maintenance, and operation of facilities and programs relating to water, flood plains, flood control, grading erosion, tree conservation, and sediment control, including the six minimum controls as outlined the City of Struthers’ Storm Water Management Plan made part, herein..
   (v)   “Storm water system” means the system or network of storm and surface water management facilities including but not limited to inlets, conduits, manholes, channels, ditches, drainage easements, retention and detention basin, infiltration facilities and other components as well as all natural waterways.
   (w)   “Undeveloped Property” means any property which has one third or less of the base unit of impervious surface area.
   (x)   “Water” means any storm water, surface water, snow melt or ground water.
