(a) The Director of Public Service may create a program for the City to replace trees on residential property in the right-of-way that are designated by the City Coordinator of Natural Resources as being in an unsafe or dangerous condition, are obstructing or compromising utilities, and/or are dead, when the City receives voluntary payment of fifty percent (50%) of the shared costs of replacing said tree from the owner of the property on which the tree is located. Shared costs include, but not be limited to, any cost the City or its Contractor incurs, such as the cost to remove the unsafe or dead tree, grinding of stumps, the amount to purchase a new tree and planting of the new tree.
(b) The Director of Public Service shall run the right-of-way tree replacement program in any year funds are appropriated for the program.
(c) The program shall be available to any residential property owner whose tree(s) in the right-of-way is determined by the City Coordinator of Natural Resources to be in an unsafe or dangerous condition, is obstructing or compromising utilities, and/or is dead, on a first-come, first-served basis, to the extent funds are available.
(d) The City or its Contractor shall perform all services related to removing the designated tree and planting of the new tree. The City Coordinator of Natural Resources shall determine the type of tree to be used for each replacement tree.
(e) Prior to performing the services set forth herein, the Director of Public Service or designee shall provide the property owner with a written estimate as to the shared costs that will be incurred. The Director of Public Service shall not authorize any work to be performed until the property owner has paid his/her fifty percent (50%) share based on the Director's written estimate.
(f) Any funds received by the City pursuant to this Section shall be placed in the Tree Maintenance Fund.
