(a) Any person who violates any provision of this chapter shall be fined not less than five dollars $5.00) nor more than five hundred dollars ($500.00) for each offense. A separate offense shall be deemed committed on each day during or on which a violation occurs or continues.’
(b) In addition to any other penalty provided herein, any person who violates any provision of this chapter shall forfeit and pay to the City a civil penalty equal to the total value of those trees illegally removed or damaged, as computed from the International Society of Arboriculture most current shade tree value formula. Said sum shall accrue to the City and may be recovered in a civil action brought by the city. Any sum so collected shall be placed in the City’s Tree Fund. (Ord. 2001-33. Passed 9-17-01.)
