(a) Whenever the office of a member of Council shall become vacant for any reason, the vacancy shall be filled for the unexpired term by an appointment made by a majority vote of all remaining members of Council. Such appointment shall be made within thirty (30) days after the next regular meeting following receipt of official notification by Council of such vacancy. If Council fails to fill the vacancy within said thirty (30) day period, the Mayor shall make the appointment. (Article III, Section 8 of City Charter). Council shall advertise and accept applications or resumes from interested parties to fill such vacancy. If the vacancy is in an office of a Councilman representing a ward, such vacancy must be filled from that ward. If the vacancy occurs in the office of a Councilman-at-large, such vacancy may be filled from any ward within the Municipality.
(b) A vacancy in the office of President or President Pro Tem of Council shall be filled by a majority vote of the remaining members of Council. The President pro tem shall be vested with all the rights and perform all the duties and functions of any other member of Council. In addition, the President pro tem shall preside at all meetings of Council at which he is present and at which the President of Council is absent and shall sign all ordinances passed and resolutions adopted at such meetings.
(c) It shall be the duty of each Council member to notify the President or Clerk of Council of any anticipated absence from any Council meeting as soon as is practicable.
(d) The resignation of a member of Council shall not take effect until the same has been accepted by a vote of the majority of the members, exclusive of the person tendering the resignation.
