Council declares the use of tents or canvas-covered booths or stands within the Municipality for residential purposes or for the storing, handling or selling of food stuffs, to be a health menace and against the public welfare. The same is, therefore, prohibited except in cases of emergency, and only then pursuant to a permit therefor to be issued by the Clerk of Council, after application therefor and after action thereon by Council. Upon good cause shown, Council shall issue such a permit under such conditions as it may then deem necessary to impose, but in no case shall such permit extend beyond a period of thirty days. Any permit so ordered issued shall be issued by the Clerk upon payment to him of a permit fee of one dollar ($1.00) towards the cost of such supervision and regulation of such occupancy or use as Council may find necessary and proper, such fee to be credited to the General Fund of the Municipality.

Whoever violates or fails to comply with any of the provisions of this chapter is guilty of a misdemeanor of the fourth degree and shall be fined not more than two hundred fifty dollars ($250.00) or imprisoned not more than thirty days, or both, for each offense. A separate offense shall be deemed committed each day during or on which a violation or noncompliance occurs or continues.
