1442.09 MAINTENANCE OF PREMISES DURING DEVELOPMENT, CONSTRUCTION, RECONSTRUCTION AND REPAIR.
   (a)    During the period of time that any construction, reconstruction or repair work is being done on any premises or within any subdivision within the City, the owner, the employing contractor and all persons performing work shall be responsible for the following:
      (1)    All safety practices and facilities required by law shall be provided and maintained.
      (2)    Any excavation that exists on the premises at the close of a working day shall be properly barricaded and lighted.
      (3)    Proper and adequate toilet facilities shall be provided for the workers.
      (4)    The sidewalk and tree lawn area of the premises shall be kept open, in repair and free from holes, depressions, areas of mud and water, building materials and debris and other nuisances.
      (5)    In any subdivision all vacant and cleared lands shall be graded and seeded or planted with ground cover to prevent erosion and shall be kept trimmed a minimum distance of fifty feet from the right of way, and shall not be permitted to become overgrown or unsightly.
      (6)    All premises and subdivision lands shall be maintained in compliance with the applicable requirements of Section 1442.08.
      (7)    The engines to all equipment shall be turned off and cooled prior to and during any refueling operation.
   (b)    When any owner of land has received approval for record purposes of a planned subdivision of lands in the City, it shall be the duty of such owner and his successors and assigns to keep the premises of each undeveloped lot in such subdivision free of hazards and in compliance with all applicable provisions of this chapter until such time as the last developable lot in such subdivision is developed or until such person or entity submits written documentation to the City evidencing that a successor in interest to such undeveloped lots has specifically assumed such duty.
