(a) A pond, lake, reservoir or other impoundment of water conforming to the regulations prevailing on the effective date of this chapter but which does not conform with the provisions of this chapter shall be construed as a legal nonconforming pond, lake, reservoir or other impoundment of water.
(b) A legal nonconforming pond, lake, reservoir or other impoundment of water may be maintained without compliance with the provisions of this chapter. However, it shall not be altered, modified, or changed in any manner whatsoever until the permit required by this chapter is first obtained and until the pond, lake, reservoir or other impoundment of water is brought into compliance with all the provisions of this chapter.
