Floods from stormwater runoff may occasionally occur which exceed the capacity of storm drainage facilities constructed, operated and/or maintained by the City. This Title Five does not imply that property served by the system established herein will always be free from stormwater flooding or flood damage, or that stormwater systems or facilities capable of handling all storm events can be cost effectively constructed, operated and/or maintained. This Title Five shall not be construed to create a liability on the part of or give rise to a cause of action against the City or any officer or employee thereof for any flood damage that may result from storms or the runoff thereof.
