1052.05 OPERATION AND PROCEDURES.
   (a)   The Board shall choose its own officers, make its own rules and regulations and keep a journal of its proceedings. In the absence of any rule upon the matter of business, the Board shall be governed by Robert’s Rules of Order. A majority of the members shall be a quorum for the transaction of business. All plans, findings, advice, reports and recommendations made by the Board shall be in writing and shall designate by name those members of the Board approving or concurring therein. Members who do not so approve or concur therein may, as part of such report, state their reasons for refusing to approve or concur.
   (b)   Street lighting location plans for all new installations shall be submitted to the Board for review and recommendation. In the case of proposed lighting of public ways in new subdivisions or new roadways, a street lighting plan shall be submitted to the City Engineer with the public improvement plans for the proposed work. The City Engineer shall refer the plan to the Board for its review and recommendation. In the case of proposed lighting or change in lighting of existing streets or public ways, proposed street lighting locations may be submitted by the Mayor, one or more members of Council or by petition of the residents in the area of the proposed location. Each such request shall be submitted to the City Engineer who shall refer the request to the Board for its review and recommendation. The review and recommendation of the Board of any new lighting installation may be based on the following considerations:
      (1)   The affect of the proposed lighting on the safety of vehicular and pedestrian traffic;
      (2)   The affect of the proposed lighting on the use and enjoyment of private lands;
      (3)   The existing illumination provided from existing public or private installations;
      (4)   The percentage of the landowners and/or residents within the area who have approved the proposed lighting; and
      (5)   The financial priorities and abilities of the City to finance the initial and continuing costs of the proposed lighting.
   The Mayor and the Council shall consider the recommendation of the Board in authorizing and/or approving lighting installations. The provisions of this chapter shall not limit the authority of the Mayor to authorize street lighting installations, removals, or other changes for the protection of the public safety.
