No person, firm or corporation shall make any tap in or connection with the water main heretofore installed in Hunt Road on either side thereof between Station 29+50 centerline Hunt Road to Station 56+80 centerline Hunt Road southeast on Hunt Road 2,730 feet thereof, for the purpose of serving or providing with a water supply any of the lots or parcels of land on either side of such improvement, until the person, firm or corporation making or causing or ordering such tap or connection shall have first paid to the Director of Finance a sum of money sufficient to pay the fair share of the cost of constructing and installing such water main past the lot or land to serve which such tap or connection is made. Council hereby determines that such fair share of cost shall be the sum obtained by multiplying the sum of fifteen dollars and sixty-two cents ($15.62) by the number of front feet on Hunt Road by the lot or land for which such tap or connection is installed.
(b) Upon payment of any such sum to the Director of Finance of the City, the Director shall be authorized to draw a proper check or warrant upon such funds, in the amount thereof payable to Past Development Company or its successors and assigns. Nothing in this section shall be construed in any way to obligate the City or any of its officers or employees thereof to undertake proceedings of any sort to enforce the collection of the sums mentioned in subsection (a) hereof or to impose any liability upon the City, any official or employee thereof for failure to collect any such sum, or to preclude any suit or remedy which Past Development Company, its successors or assigns may have in law or in equity against any person, firm or corporation for unauthorized use of, tapping into or connection with such water main.
