(a) The City reserves the right to regulate rates for Basic Cable Service and any other services offered over the Cable System, to the extent permitted by federal or State law. The Grantee shall be subject to the rate regulation provisions provided for herein, and those of the Federal Communications Commission (FCC) at 47 C.F.R., Part 76.900, Subpart N. The City shall follow the rules relating to cable rate regulation promulgated by the FCC at 47 C.F.R., Part 76.900, Subpart N.
(b) Each Grantee shall have a rate structure, for the provision of cable service, that is uniform throughout the geographic area in which cable service is provided over its Cable System when and to the extent a uniform rate structure is required pursuant to the provisions of federal law (47 U.S.C. §543(d)) as the same may be amended from time to time.
(c) Each Grantee shall offer a Senior Citizen Discount to all eligible subscribers, upon proof of age as specified in the Franchise Agreement. Such discount may be added into the rate regulation calculation as a requirement of the Franchise.
(d) Nothing herein shall prohibit Grantee from offering bulk or bundled discounts and/or special promotions for the purpose of attracting subscribers or users, or establishing different rates and charges of services for commercial subscribers, or different monthly rates for classes of commercial subscribers upon written notice to Grantor, provided that any such discounts, promotions or differing rates are not discriminatory under the provisions of federal law.
(e) Each Grantee shall offer Broadcast Basic service, so long as required by federal law or regulation, which, at a minimum, shall consist of all local, over-the-air Channels and PEG Channels, and will not require a converter for cable-ready TVs and VCRs for such service.
