814.01 SURVEILLANCE CAMERAS REQUIRED FOR ATM MACHINES.
   (a)   For the purposes of this section, “structure” shall mean any construction, or any production or piece of work artificially built up or composed of parts joined together in some definite manner; an edifice or building of any kind.
   (b)   Each bank and financial institution in the City of Strongsville providing access to an Automated Teller Machine (“ATM”) which is located on the outside of a structure or is in such a location which is accessible for use after normal business operations have closed for the day, shall have installed and have functioning, clearly visible, externally mounted cameras capable of photographing the immediate area around the ATM.
   (c)   Each bank and other financial institution in the City of Strongsville providing access to an Automated Teller Machine (“ATM”) which is located outside of a structure shall provide lighting during hours of darkness according to the following standards:
      (1)   There shall be a minimum of ten candlefoot power at the face of the ATM and within all areas within a radius of five feet from the perimeters of the ATM.
      (2)   There shall be a minimum of two candlefoot power within all areas within a radius of forty feet from the perimeters of the ATM to at least a height equal to the height of the top of the ATM.
      (3)   In the event the ATM is located on the wall of a building and within ten feet of the corner of the building, there shall be a minimum of two candlefoot power within all areas within a distance of fifteen feet from the nearest building wall adjoining the wall on which the ATM is located for a distance of forty feet from such corner of the building.
      (4)   If a property line of the land upon which the ATM is located falls within the aforesaid areas required to be lighted, lighting shall not be required beyond the property line.
   (d)   Shall not permit plantings and shrubs that may provide concealment or obstruct the visibility of the ATM or the surrounding area by passing pedestrians and vehicular traffic.
   (e)   Each bank and other financial institution providing access to an Automated Teller Machine (“ATM”) which is located outside of a building or other structure shall conduct an annual inspection on or before June 1 of each year for compliance with the standards set forth in this Section and report the results of such inspection to the Chief of Police on an inspection form available from the Police Department. The Police Department may conduct inspections from time to time for compliance with the provisions of this Section.
   (f)   Each bank or financial institution shall have installed within 300 feet of any ATM located outside of a structure, equipment which provides 911 access.
   (g)   The location of the cameras required by this section shall be inspected and approved by the Chief or Police or his designated representative.
   (h)   Whoever violates any provision of this section shall be guilty of a first degree misdemeanor.
