(1) Knowingly allow an employee to sell, transfer or trade items or services, the purchase of which is prohibited by the “Food Stamp Act of 1977,” 91 Stat. 958, 7 U.S.C.A. 2011, as amended, in exchange for food stamp coupons; or
(2) Negligently allow an employee to sell, transfer or exchange food stamp coupons for anything of value.
(b) Whoever violates this section is guilty of illegal use of food stamps, a misdemeanor of the first degree, provided the face value of the food stamp coupons involved in the violation is less than two hundred dollars ($200.00) and provided the offender has not previously been convicted of a violation of the “Food Stamp Act.” Punishment shall be as provided in Section 698.02.
