(a) The Director of Public Service may order the owner of a vacant or abandoned building to secure all doors and windows, including any or all windows in the upper floors of the building, and all public access to and parking areas of any such building. The Order shall be conspicuously attached to such vacant or abandoned building. The Director may designate the materials and procedures to be used to comply with the Order. Also, the Director may order the owner of such building to paint any boards of “plywood” or similar material used to cover any doors and windows with paint of a color that matches the color of the building.
(b) If after three (3) calendar days the owner of the vacant or abandoned building fails, neglects, or refuses to comply properly with the terms of the Order issued pursuant to this Codified Ordinance §1346.25(a) by the Director of Public Service, the Director may cause the required work to be performed by the Service Department or by an independent contractor, at the expense of such owner. The Director is not obligated to secure any building or access or parking area thereto not deemed by the Director of Public Safety to be unsafe, and upon the determination that a building or access or parking area thereto is unsafe the same is hereby declared to be a public nuisance.
(c) Any expenses incurred by the City in enforcing this section are to be collected in accordance with Section 553.04.
(d) The term “building” as used in this section has the same meaning as set forth in Section 1103.02(a)(13).
