§ 53.09 COMPOSTING SERVICE.
   (A)   There is hereby established a compost collection service for residents and property owners of the village, said compost to be collected at a location within the village established by the Mayor, after consultation with the Water and Sewer Superintendent/Village Administrator.
   (B)   This composting service is intended to be utilized as a benefit for property owners and residents of the village to dispose of material suitable for composting, and is not intended to be utilized by commercial operations or businesses to dispose of their commercial or business compostable waste.
   (C)   Each individual property, residential unit or dwelling shall be charged a monthly compost fee of $1 per month for this compost service, the same to be effective September 1, 2012 and continuing monthly thereafter.
   (D)   The above stated charges for composting service shall be billed together with prior charges for water, sewer and trash pickup by the village. The monies received from such composting service shall be deposited in the General Fund and appropriated therefrom for the purpose of paying for additional expenses related to the compost service by employees of the village utilizing equipment owned and operated by the village. Any surplus monies thereafter may be used for other village services.
   (E)   Any individual not a property owner or resident of the village who disposes of or attempts to dispose of any materials at the compost collection site shall be deemed to have committed a criminal offense.
   (F)   Any individual, whether or not a property owner or resident of the village, who disposes of or attempts to dispose of materials that are not suitable for composting at the composting service site established by the village shall also be deemed to have committed a criminal offense.
   (G)   Any commercial operation or business which attempts to utilize the compost collection service of the village for disposal of their commercial or business compostable waste shall also be deemed to have committed a criminal offense for violation of this section.
   (H)   The composting service of the village shall be available to residents and property owners of Franklin Township, Tuscarawas County, Ohio, in accordance with the terms and conditions described herein.
   (I)   An annual fee of $15 per year shall be charged to residents and property owners of Franklin Township, Tuscarawas County, Ohio, for the use of the village composting service, and upon payment of said fee to the office of the Village Fiscal Officer, the resident and property owner of Franklin Township, Tuscarawas County, Ohio, paying said fee shall receive a sticker for the calendar year for which access to the composting service is sought.
   (J)   The $15 fee for the use of the village composting service by residents and property owners of Franklin Township, Tuscarawas County, Ohio, shall be renewed annually, at the same rate or such other rate as subsequently determined by the Village Council.
   (K)   Any resident and property owner of Franklin Township, Tuscarawas County, Ohio, who wishes to pay the $15 registration fee for the use of the village composting service shall be entitled, at no additional charge, to use the village composting service.
