Final plat required: The developer, having received approval of the preliminary plat of the proposed subdivision, shall submit a final plat of the subdivision as prescribed in the Subdivision Regulations, Section 2, 3, Pages 14 and following. It shall conform to the boundaries of the preliminary plat and shall include only that portion of the approved plat which the developer proposes to record and develop at the time. | |||
An application for approval of the final plat on forms provided, together with six copies of the plat map and the supplemental information as specified below shall be submitted to the Strasburg Planning Commission. This plat map shall be prepared by a registered surveyor and the supplemental information shall be prepared by a qualified registered engineer or surveyor. | |||
Rules governing improvements: The specifications for improvements shall be a set of construction and utility plans prepared by a registered professional engineer. The plan shall include typical sections, plans, profile views, construction details and estimates of quantities. All typical sections and major engineering details to be used on a particular street shall be approved in advance by the Village Engineer before completion of the plans. The developer must install the minimum required improvements or must have furnished a performance bond for the amount of the estimated construction cost of the ultimate installation of the improvements. The bond or cash deposit will assure the village that the developer will faithfully perform and complete the work of constructing all required improvements in accordance with these regulations. The bond must be approved by the proper administrative officials before it is accepted. The term of the bond shall extend for 12 months beyond the completion date of the project. | |||
The final plat shall be drawn in India ink on Mylar, tracing cloth or other material of equal performance. The size shall be 20” x 20”, with a scale of 1” = 50’. The final plat may be drawn on a larger sheet and reduced for recording. Number each sheet in relation to all others and include an index. | |||
The final plat shall contain the following information: | |||
1. Name of the subdivision, location by street address, total acreage and total number of lots. | |||
2. Name and address of the developer(s), and of the registered surveyor who prepared the final plat. | |||
3. All plat boundaries, with lengths in feet and hundredths, and bearings to not more than half minutes. Lot dimensions shall also be shown in the same way. | |||
4. Bearings and distances to nearest established street lines or other recognized permanent monuments, which shall be accurately described the plat. | |||
5. Exact locations, right-of-way widths, building setback lines and names of all streets within and adjoining the plat. | |||
6. Radii, arcs, points of tangency and central angles all curvilinear streets and radii for any rounded corners. | |||
7. All easements and rights-of-way provided for public services or utilities and for drainage of surface water, and the limitations of such rights-of-way or easements. | |||
8. Assigned house numbers as well as lot numbers. | |||
9. Accurate outlines of areas to be dedicated or reserved for public use, or areas which are to be reserved for common uses of all property owners. | |||
10. A list of restrictions and covenants which the developer intends to include in the deeds to the lots in the subdivision shall accompany the final plat and shall be recorded prior to final plat approval. Reference to their recording shall made on the final plat. | |||
11. Certification by a registered surveyor to the effect that the plat represents a survey made by him or her and that the monuments shown therein actually exist and are accurately located, and that all dimensional details are correct. | |||
12. Notarized certification by the owner(s) of his/her/their adoption of the plat and the dedication of the streets and other public areas. | |||
13. Vicinity map of area within a one-half mile radius, including contours. | |||
The following supplemental information shall be supplied in addition to the preceding requirements: | |||
* Certification that all required improvements have either been installed or that a bond or other security has been furnished assuring installation of the required improvements. | |||
* A plan view of the streets shall be drawn to a scale of 1’ = 50’. This will show the proposed streets, street alignments, rights-of-way, pavements widths, centerlines, bearings, stationing, curve and radius data, existing and proposed drainage. All other significant features or factors shall also be shown on the plan. The centerline of streets shall coincide with the centerline of the rights-of-way. The village Engineer may make changes at his or her discretion. | |||
Filing: The final plat shall be filed with the Planning Commission no later than 12 months after the date of the approval of the preliminary plat; otherwise it will be considered void, unless an extension is requested (in writing) by the developer and granted (in writing) by the Commission. The final plat shall be considered officially filed after it has been examined by the Village Engineer and is found to be in full compliance with the formal provisions of the Subdivision Regulations. It shall be filed at least ten working days prior to the meeting at is to be considered. | |||
The developer shall submit a statement of the proposed use of the lots, stating the type of residential buildings and the proposed number of dwelling units, to determine the impact of the development on the area. The impact items of concern are: increased auto traffic, fire protection and hazards, population congestion, surface water drainage and flood control. | |||
Approval: The Commission shall take action on the final plat within 30 days after the same has been officially filed as stated in R.C. § 711.05; otherwise said plat shall be deemed to have been approved. The certificate of the Commission as to the date of the submission of the plat for approval, and the failure to take action within such time, shall be sufficient in lieu of the written endorsement or evidence of approval herein required. If disapproved, the grounds for disapproval of the final plat shall be stated on the record of the Commission, including the reference to the regulation violated by the plat, and copy of said record of the Commission shall be forwarded to the developer. The developer shall make the necessary correction(s) and resubmit the final plat within 30 days to the Commission for its approval. | |||
The developer will be notified of the final approval in writing by the Commission. The developer shall then present the final plat to the Village Council for its approval. | |||
Recording of the final plat: After the final plat has been approved by the Commission, the Village Engineer, the Village Administrator, and the Water and Sewer Superintendent, and their approvals endorsed in writing thereon, together with evidence of title, it may then be filed for recording in the office of the Recorder of Tuscarawas County as required by law. Evidence of such filing must be delivered by the developer to the Strasburg Village office. | |||

Deed transfers: (See Jurisdiction, Para. 3). Whenever any transfer is to be made of parcels described in this paragraph, the party or parties desiring to make the transfer shall submit a sketch thereof to the Planning Commission. If the division conforms to appropriate standards, the responsible official may stamp the map, “Approved, No Plat Required” and attach his or her signature, and the appropriate transfer may then be recorded. However, if the owner of the property does not agree with any of the requirements specified by the Commission, he or she may then appeal to the Village Council for approval for recording, and such approval must be obtained before the transfer can be recorded. No preliminary or final plan other than the rough sketch of the division shall be required, and none of the improvements described in Section 4 of the Subdivision Regulations shall be required for the transfer. | |||
The fee as specified in the filing fee schedule, must accompany the final plat filing and the final plat will not be considered filed without said fee. | |||
