929.01 DEFINITIONS.
   As used in this chapter, the following words and phrases shall have the meanings set
forth herein.
   (1)    "Building drain" means that part of the lowest horizontal piping of a drainage system which receives the discharge from soil, waste and other drainage pipes inside the walls of a building and conveys it to the building sewer beginning three feet outside the building wall.
   (2)    "Building sewer" means the extension from the building drain to the public sewer or other place of disposal.
   (3)    "City" means City of St. Clairsville, Ohio, acting through its duly authorized officials and employees.
   (4)    "Combined sewer" means a sewer intended to receive both wastewater and storm or surface water.
   (5)    "Commercial user" means any user of the sewage systems not specifically categorized as residential or industrial and generally classified in the Standard Industrial Classification Manual (S.I.C.) in Division F - Wholesale Trade; Division G - Retail Trade; Division H - Finance, Insurance and Real Estate; portions of Division I - Services; and Division J - Public Administration.
   (6)    "Domestic sewage" means sewage derived principally from dwellings, business buildings, institutions and the like, which originates within the building, including the waste from kitchens, water closets, lavatories, bathrooms, showers and laundries.
   (7)    "Foundation drains" means subsurface drains laid around the foundation of a building, either within or outside the building foundation for the purpose of carrying ground or subsurface water to some point of disposal.
   (8)    "Garbage" means solid wastes from the domestic and commercial preparation, cooking and dispensing of food, and from the commercial handling, storage and sale of produce.
   (9)    “Industrial user” means any nongovernmental user of the publicly owned treatment works identified in the Standard Industrial Classification Manual of the U.S. Office of Management and Budget, as amended and supplemented, under the following divisions: Division A - Agriculture, Forestry and Fishing; Division B - Mining; Division D - Manufacturing; Division E - Transportation, Communication, Electric, Gas and Sanitary Service; Division I - Services. A user in the division listed may be excluded if it is determined that it will introduce primarily segregated domestic waste or wastes from sanitary conveniences.
   (10)    “Industrial waste” means the liquid and water-carried wastes resulting from the processes employed in industrial manufacturing, trade or business establishments, as distinct from domestic wastes.
   (11)    “Infiltration” means the water entering a sewer system, including building drains and sewers, from the ground, through such means as, but not limited to, defective pipes, pipe joints, connections or manhole walls. “Infiltration” does not include and is distinguished from "inflow".
   (12)    "Inflow" means the water discharged into a sewer system including building drains and sewers, from such sources as, but not limited to, roof leaders, cellar, yard and area drains, foundation drains, unpolluted cooling water discharges, drains from springs and swampy areas, manhole covers, cross connections from storm sewers and combined sewers, catch basins, storm waters, surface run-off, street wash waters or drainage. “Inflow” does not include, and is distinguished from “infiltration”.
.    (13)    “Infiltration/inflow” means the total quantity of water from both infiltration and inflow without distinguishing the source.
   (14)    "May" is permissive; "shall" is mandatory.
   (15)    "Natural outlet" means an outlet, including storm sewers and combined sewer overflows, into a watercourse, pond, ditch, lake or other body of surface or groundwater.
   (16)    "Nonsanitary flow" means storm water originating from downspouts, storm and groundwater drains, and foundation drains.
   (17)    "NPDES Permit" means a permit issued under the National Pollutant Discharge Elimination System for the discharge of wastewaters to navigable waters of the United States pursuant to Section 402 of PL 92-500.
   (18)    "Person" means any individual, firm, company, association, society, corporation, partnership or group.
   (19)    "Public sewer" means any sewer owned by the City, including storm, sanitary or combined sewers.
   (20)    "Residential user" means any user discharging wastes from buildings or premises that are used as permanent place for human occupancy such as single-family dwellings, rowhouses, townhouses, mobile homes, garden and standard apartment, and high-rise apartments. Transient lodging, considered commercial in nature is not included.
   (21)    "Sanitary sewer" means a sewer which carries sanitary and industrial wastes, and to which storm, surface and groundwater are not intentionally admitted.
   (22)    "Sewage" means the combination of the liquid and water-carried wastes from residences, commercial buildings, industrial plants and institutions, including polluted cooling water.
   (23)    "Sewage system" means the structures, equipment and process required to collect, transport and treat domestic and industrial wastes and dispose of the effluent and accumulated residual solids and shall be synonymous with "wastewater treatment system".
   (24)    "Storm sewer" means a pipe or conduit designed for the purpose of carrying storm, surface, cooling and drainage water from the point of origin to some point of disposal, but which is not intended to carry domestic or industrial sewage.
   (25)    "Shall" is mandatory, "may" is permissive.
   (26)    "Slug" means any discharge of water or wastewater which in concentration of any given constituent or in quantity of flow exceeds for any period of duration longer than fifteen minutes more than five times the average twenty-four hour concentration of flows during normal operation.
   (27)    "User" means any person who discharges, causes or permits the discharge of wastewater into the wastewater treatment system.
   (28)    "Wastewater" means the liquid and water-carried waste from dwellings, commercial buildings, industrial facilities and institutions, together with any groundwater, surface water or storm water that may be present, whether treated or untreated, which is discharged or permitted to enter the wastewater treatment system.
   (29)    "Wastewater treatment system" means the structures, equipment and process required to collect, transport and treat domestic and industrial wastes and dispose of the effluent and accumulated residual solids and is synonymous with "sewage system".
