919.02 DEFINITIONS.
   For the purpose of this chapter the following terms, phrases, words and their derivations have the meanings given herein. When not inconsistent with the context, words used in the present tense include the future, words in the plural include the singular, and words in the singular include the plural. "Shall" is mandatory and not merely directory.
   (a)    “City” means the incorporated City of St. Clairsville, Ohio.
   (b)    "Person" means any person, firm, partnership, association, corporation, company or organization of any kind.
   (c)    “Street” or “highway” means the entire width of every public way or right of way when any part thereof is open to the use of the public, as a matter of right, for purposes of vehicular or pedestrian traffic.
   (d)    "Park" includes all City-owned parks.
   (e)    "Public lands", "public areas", or "public property" means all grounds owned or controlled by the City.
   (f)    "Property line" means the legal boundary line.
   (g)    "Lawn strip", "tree lawn", or "curb strip" means that part of a street or highway right of way outside of the portion improved for travel.
   (h)    "Public trees" includes all shade and ornamental trees now or hereafter growing on any street, including lawn strip, tree lawn or curb strip or on any other City-owned land.
   (i)    "Trees" include all trees, regardless of species and height, and all woody shrubs, regardless of size or height.
   (j)    "Large trees" are designated as those attaining a height of forty-five feet or more.
   (k)    "Medium trees" are designated as those attaining a height of thirty to forty-five feet.
   (l)    "Small trees" are designated as those attaining a height of twenty to thirty feet.
   (m)    "Property owner" means the person owning such property as shown by the Deed Records of the County.
   (n)    "Shade or ornamental tree or shrub" means any and all woody vegetation.
   (o)    "Dripline" means the approximate circular vertical extension to the ground of the outer most branches and leaves of the tree as an indication of the spread of the root system.
