When a written consent for a street excavation is issued by Council to any person, firm or corporation, before any work is started, the person, firm or corporation shall, if directed by Council to do so, furnish a bond in an amount to be determined by Council at the time the written consent is given, conditioned that such person, firm or corporation will save the Municipality harmless from any and all liability or responsibility caused by the negligence of such person, firm or corporation, or any employee of such person, firm or corporation.
Such bond shall further be conditioned that such person, firm or corporation shall keep the place where the excavation was made in a safe and proper manner for a period of one year from the date of the written consent to make such excavation and shall save the Municipality harmless from any and all claims for damages caused by the negligence of the person, firm or corporation or their agents, in failing to keep such place in proper repair.
