339.13 REDUCTION OF WEIGHT LIMITS DURING TIMES OF THAW OR MOISTURE.
   (a)   When thaw or excessive moisture renders any improved street of the Municipality or any section thereof insufficient to bear traffic thereon, or when any such improved street or section thereof would be damaged or destroyed by heavy traffic during the period of thaw or excessive moisture, the maximum weight of a vehicle and load shall be reduced when, in the opinion of Council, the same is necessary.
   The reduction of weight as made by Council during times of thaw and excessive moisture shall not be below seven and one-half tons, which would be the weight of the truck and load combined.
   Council, before placing into effect any reduction of the weight and load under this section, shall give at least two days notice of such reduction before such reduction in weight shall become effective. Council shall cause to be placed and remain upon such improved street or section thereof, at both ends, and at the point of intersection with principal streets, during the period of reduced limitations in weight, signs of substantial construction which will conspicuously indicate the weight limits of the vehicle and load permitted on such street or section thereof. No person shall operate a vehicle, whose maximum weight is in excess of the limit so prescribed on such street or section thereof. (Vol. 3, p. 7, passed 11-7-27.)
   (b)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense within one year after the first offense, the person is guilty of a misdemeanor of the fourth degree; on each subsequent offense within one year after the first offense, the person is guilty of a misdemeanor of the third degree.
