521.10 PORTABLE ATHLETIC DEVICES PROHIBITED.
   (a)   All portable athletic devices, such as basketball hoops and backboards, are not permitted to be erected on City property, including all easements, rights-of-way, public streets and sidewalks.
   (b)   The installation/placement of portable athletic devices such as basketball hoops or backboards on private property is permitted provided the activity created by said devices will not take place on public streets, sidewalks and rights-of-way.
   (c)   In the event of a violation of this section, notice shall be given to any homeowner or renter in violation of this section by either the Planning and Zoning Administrator or St. Clairsville Police Department to remove such devices within three (3) days. If not removed, the City of St. Clairsville’s Street Department will impound such devices and only release them to the parent or guardian after a fine has been paid.
   (d)   Whoever violates any provision of this section is guilty of a minor misdemeanor on a first offense; on a second offense, the person is guilty of a misdemeanor of the fourth degree; and on each subsequent offense, the person is guilty of a misdemeanor of the third degree.
