Section 4. Vacancy - Creation of.
   Once elected and sworn in, a member of Council shall vacate his office under any of the following conditions:
   By removal of his permanent residence to a place outside the limits of the City, or if a representative of a Ward, to a place outside the limits of such Ward.
   By written resignation filed with the Clerk of Council.
   By the acceptance of and entering upon the duties of another elected public office.
   By being interested in a contract, job, work or service with the City in a manner prohibited by general law or by the Charter, or enactments of Council pursuant thereto, determined by two- thirds of full membership of Council.
   By absence without excuse acceptable to two-thirds of full membership of Council at four (4) regular consecutive meetings.
   By being recalled from office.
   By removal from office for malfeasance, misfeasance or nonfeasance as provided by general law.
   By conviction while in office of a crime involving moral turpitude.
   By being adjudicated legally incompetent.
   By being called to full-time military service for a period exceeding sixty-one (61) consecutive days.
   By receiving compensation for his services as a Committeeman or as a member contrary to law.
   By death.
   Prior to any such action by Council, the accused member shall be notified in writing of the charge against him or her, at least fifteen (15) days in advance of any hearing upon such charge, and he and his counsel shall be given an opportunity to be heard, present evidence, or examine under oath, any witness in support of such charge.
