917.02 SERVICE CHARGE RATES.
   For the purpose as provided in Sections 917.01 and 917.06, there is levied and assessed upon such premises having any sewer connection with the sewage system of the City or otherwise discharging sanitary sewage, industrial waste, water or other liquids, either directly or indirectly into the City sewage system, and upon the owner of such premises, a sewage service charge or rental at rates to be in effect and payable as hereinafter provided, and in the amount, as applicable, to be determined as follows:
     (a)   For any premises situated within the corporate limits or within the JEDD, and having any connection with the sewage system or otherwise discharging sanitary sewage, industrial wastes, water or other liquids, either directly or indirectly into the City's sewage system, the service charge or rental shall be based upon the quantity of water used thereon or therein as the same is measured by the City water meter there in use and any increases in such quantity as provided pursuant to Section 916.02.

   (d)   The maximum monthly charges for premises containing a one or two-family dwelling shall be based on the wintertime water usage as measured by the meter reading in February. The wintertime water usage shall be used to determine the sewer charge for the 12 month period beginning in May and continuing through the following April. In the event that a February water meter reading was not taken, or that the February water meter reading when multiplied by twelve does not reflect the true annual sewer usage, the Director of Finance shall base the sewer charges on the average monthly usage for the preceding year or on some other equitable basis which more accurately reflects the actual sewer usage. However, in no event shall charges per month be less than the minimum charges provided for each respective calendar year as shown in 917.02(e). Premises containing dwellings for three or more families, and commercial properties shall be charged at the rate set forth in subsections (a), (b), and (c) hereof.
   (e)   Minimum Charges: The following minimum charges per month based on the following meter sizes shall be charged for sewer service. These rates are effective January 1, 2022.

   (q)   Notwithstanding the provisions of subsections (a) through (o) hereof, non-residential premises that are connected to the City sewage system, but not to the water system, and for which the Service Director has not required the installation of a water meter, will be billed at the following rate:

   (r)   If a lot, parcel of land, building, or premises discharges sanitary sewage, industrial wastes, water, or other liquids into the City sanitary sewage system, but is not a user of water supplied by the City, the Service Director may require the owner of such lot to install a meter measuring water being furnished to the lot in order to measure discharges into the City sanitary sewer system. The meter and its installation must be approved by the Service Director and arrangements satisfactory to the Finance Director must be made to obtain readings to measure sewer usage and generate an accurate bill. The owner's charges will then be based on the water usage as measured by such meter at rates set forth in 917.02.
   (s)   If a lot, parcel of land, building or premises, discharges sanitary sewage, industrial wastes, water or other liquids into the City sanitary sewage system, but is not a user of water supplied by the City, the owner of such lot may install a sewer meter or other device on the premises that will more truly measure discharges into the City sanitary sewer system, provided that such sewer meter or other device and its installation have been approved by the Service Director and arrangements satisfactory to the Finance Director have been made to obtain readings to measure sewer usage and generate an accurate bill.
   (t)   If an owner of a lot, parcel of land, building or premises, that discharges sanitary sewage, industrial wastes, water or other liquids into the City sanitary sewage system shows to the satisfaction of the Service Director that the volume of discharges into the City sanitary sewer is not fairly reflected by the amount of City water used on such lot, the owner of such lot may install a sewer meter or other device on the premises that will more truly measure discharges into the City sanitary sewer system, provided that such sewer meter or other device and its installation have been approved by the Service Director and arrangements satisfactory to the Finance Director have been made to obtain readings to measure sewer usage.
   (u)   Voluntarily accepted additional service charges: The charges pertaining to a property owner's allocated share of total costs to design, construct, and collect costs related to City constructed water utility improvements benefiting the property and which a property owner has voluntarily accepted, in writing, as additional service charges. The voluntarily accepted additional service charges shall be billed to the customer receiving services at the property to which the voluntarily accepted additional service charges apply, regardless of changes in ownership, until paid in full.
   (v)   No sewage service charge shall be imposed upon premises owned or operated by either the City of Springfield or by National Trail Parks and Recreation District.
