Any person opening, constructing, reconstructing or repairing a driveway or driveway apron within the public right-of-way shall obtain a permit therefor, in compliance with the following provisions:
(A) An application for a permit for the construction, reconstruction, or repair of a driveway or driveway apron within the public right-of-way at a private residence, shall be submitted to the building department accompanied by a sketch showing the lot lines and the dimensions of the proposed improvement or repair. The sketch may be made by the owner of the residence or the applicant.
(B) Application for a permit for the construction, reconstruction or repair of a driveway or driveway apron within the public right-of-way on business or industrial property, shall be submitted to the building official, giving detailed plans, in triplicate, of the proposed construction, reconstruction, or repair, prepared by an architect or engineer showing lot lines, street curb lines and indicating whether or not the curb is to be cut, the finished surface grade of the proposed installation, street inlets, all public utility structures which may be affected by, or which are immediately adjacent to, the proposed installation, and such other information as may be reasonably necessary to determine the exact nature and extent of the work.
(C) The building official shall issue all permits for the construction, reconstruction, or repair of driveways and driveway aprons within the public right-of-way upon proper application, upon payment of the fee herein provided, and upon the required sketch or plan being approved by the city engineer and/or superintendent of public works that the location of driveways and curb cuts and the specifications for their construction meet the requirements of this code or development plans that have been approved by the planning commission.
(D) For any new construction or alterations to an existing driveway apron, the owner shall pay any applicable fees, including the processing base fee, driveway permit fee, and applicable penalty fees, as set forth in § 152.20(G) of this Code of Ordinances. The Processing Base Fee is intended to address the cost incurred by the Building Official in processing and reviewing the driveway permit application. The Driveway Fee is intended to address the cost incurred by the Public Works Department in reviewing and inspecting the new work which is authorized by § 93.01 herein.
