(A) The Board shall have the power to hear and decide appeals, on timely completed application by a person adversely affected by a refusal to issue a permit, interpretation, ruling, or order of the Chief Building Official or Chief of the Fire Prevention Bureau, only on either or both of the following grounds:
(1) An interpretation, ruling, order, or refusal to issue a permit by the Chief Building Official or Chief of the Fire Prevention Bureau is contrary to a fair interpretation of the provisions of the City or Ohio Building Codes, or the Fire Code.
(2) The strict application of a particular provision or provisions of the City or Ohio Building Codes or City Fire Code imposes an undue hardship on the complainant, and a modified interpretation, order, ruling, or permit is available and feasible whereby the hardship can be relieved without being contrary to the public health, safety, and welfare, such that the spirit of the aforementioned codes can be observed and substantial justice done.
(B) The Board shall affirm, reverse, or modify the decision, interpretation, ruling, or order provided the Board shall reverse or modify the decision only on one of the grounds stated in this section.
