§ 73.06 RULES AND REGULATIONS.
   (A)   A cart may be operated on any public roadway within the town limits where the posted speed limit does not exceed 35 mph.
   (B)   Carts may not be operated, parked or stopped on trails, greenways (e.g., the Thermal Belt Rail Trail), sidewalks or other areas prohibited from use by motor vehicles.
   (C)   Carts must adhere to the same parking regulations as any other motor vehicle. The use of handicapped spaces by carts is allowed; however, a handicapped parking permit issued by the state DMV must be displayed and the person it is issued to must be the operator or a passenger.
   (D)   Operators of carts must be 16 years of age and possess a valid state issued driver’s license which must be presented upon request by any officer. No person may operate a golf cart unless that person is licensed to drive upon the public streets, roads and highways of the state or another state and then, only in accordance with such valid driver’s license. Golf cart operators must carry their driver’s license on their person at all times while operating a golf cart on public roads.
   (E)   A valid certificate of registration and certificate of insurance must be possessed by the operator of any cart and presented upon request by any officer.
   (F)   All carts must have installed and in working order the required equipment specified in § 73.04 of this chapter.
   (G)   The operator of any cart shall yield the right-of-way to traditional motor vehicles so as to accommodate the flow of traffic. Golf carts must be operated at the right edge of the roadway and must yield to all vehicular and pedestrian traffic.
   (H)   The operator and passengers must be properly seated while the cart is in motion, with seat belts properly fastened. An operator may not allow the number of people in the golf cart at any one time to exceed the maximum capacity specified by the manufacturer. Persons or cargo may not be transported in a negligent manner. The seating capacity with seat belts may not be exceeded. The operator shall not allow passengers to ride on any part of a golf cart not designed to carry passengers, such as the part of the golf cart designed to carry golf bags.
   (I)   No cart shall be operated at a speed greater than reasonable and prudent for the existing conditions and in no instance at a speed greater than 20 mph.
   (J)   No cart may be operated in a careless or reckless manner.
   (K)   Carts must be operated in accordance with all applicable state and local traffic laws, rules, regulations, and ordinances, including all laws, rules, regulations and ordinances pertaining to the possession and consumption of alcoholic beverages and all other illegal drugs. The possession of open containers of alcohol and/or consumption of alcohol by the operator or passengers is prohibited.
   (L)   No cart shall be operated on or across any public or private property outside the street right- of-way without the permission of the property owner.
   (M)   Golf carts shall not be operated during inclement weather or when visibility is impaired by weather, smoke, fog or other conditions.
