(A) It shall be unlawful for any person or business to haul solid waste material that originates in the county without first having completed and filed with the County Solid Waste Management District the necessary registration forms.
(B) SOLID WASTE HAULER shall mean any owner or operator of a solid waste hauling company, independent contractor, or private individual which provides solid waste disposal service to the county, or which benefits residents, businesses, or others which reside or do business in the county.
(C) (1) This section shall not apply to any person hauling or transporting waste which originates from the hauler’s own property or business, unless the hauling of such waste requires the owner or operator to use a rear loader commercial type vehicle, front end loader commercial type vehicle, roll off, or transfer type commercial vehicle.
(2) The owner or operator of the above described transfer-type commercial vehicle shall be a solid waste hauler, whether or not said owner or operator receives compensation for providing such service.
(D) Any county governmental subdivision and its employees, including any city or town, shall not be considered a solid waste hauler when hauling, transporting, or disposing of solid waste for, and on behalf of, such subdivision.
(E) (1) All solid waste haulers shall be required annually to register and obtain a permit before providing solid waste hauling, transportation, or disposal services within the County Solid Waste Management District. Said permit shall be obtained from the County Solid Waste Management District office.
(2) The solid waste hauler shall provide the following information on the registration form provided by the Solid Waste Management District:
(a) The hauler’s full name;
(b) Address;
(c) Daytime phone number;
(d) Emergency phone number;
(e) Designated responsible person to be in contact with concerning the hauler’s day-to-day operations;
(f) General location of the waste hauler; and
(g) Route designation of various areas served within the waste disposal district and, where possible, maps of service territories.
(3) The route and map information may be forwarded to the County Highway Department for its use.
(4) In addition, the hauler shall be required to file a report each calendar quarter with the Solid Waste Management District indicating the total tonnage of recyclables processed, the tonnage of municipal waste collected, and the final disposal site.
(F) The Solid Waste Management District shall be entitled to impose a reasonable fee for the issuance of an annual permit to defray the cost of its issuance and the record keeping requirements associated therewith, which fee shall be $15 per permittee regardless of how many vehicles any one permittee may operate in the county.
(G) A permit license issued pursuant to this section shall run from January 1 through December 31 of the same year.
(H) Any permittee operating a vehicle subject to this section shall boldly display on the back and sides of each such vehicle operated in the county the name of the permittee in letters not less than four inches high.
(I) (1) Drivers of all vehicles subject to this section shall cause the contents of such vehicles to be adequately confined during conveyance so as to prevent littering.
(2) It shall be unlawful for the drivers of any waste hauling vehicle to allow the contents thereof to spill upon any public right-of-way.
