(A) No person shall engage in or otherwise participate in the operation of any taxi service within the town unless such person shall have first obtained a permit granted pursuant to the provisions of this chapter.
(B) Any person seeking issuance of a taxi service permit shall file a written application with the chief on a form supplied by the town. Submission of any false or misleading information to obtain or renew a Permit shall be grounds for denial, suspension or revocation of such permit. At a minimum, the application shall include:
(1) A list of all motor vehicles that applicant proposes to use in the taxi service; and
(2) A list of all drivers whom applicant proposes to use in the taxi service.
(C) The chief will conduct an investigation to determine applicant's qualifications. Submission of an application for a taxi service permit shall constitute a waiver of any privileges and rights of privacy with respect to any document in existence reasonably related to the determination of the applicant's qualifications and shall serve as an authorization to the chief to make inquiry of any person or entity, and to receive any oral or written reports from any person or entity, regarding any facts, evidence or information reasonably related to the determination of the applicant's qualifications. If needed, the applicant shall sign a separate written authorization for the release of documents or information concerning the applicant.
(D) No taxi service permit will be issued unless the applicant meets the following requirements:
(1) The applicant is at least 18 years of age or is otherwise legally emancipated and is a U.S. citizen or possesses documentation of eligibility to work in the United States;
(2) The applicant has not has been convicted within the last ten years of any of the following:
(a) Any felony against the state or any offense against another state which would have been a felony if committed in North Carolina;
(b) Any federal or state law relating to the use, possession, or sale of alcoholic beverages or narcotic or barbiturate drugs; and
(c) Any federal or state law relating to prostitution;
(E) The chief upon completion of a permit investigation, shall make a report with recommendations to the Council regarding approval or denial of a permit or a renewal based on an investigation.
(F) A permit shall be nonexclusive and shall be granted for a term of three years from effective date of the permit. The permit may be renewed for terms of three years. Renewal requests must be forwarded to the chief at least 30 days prior to permit expiration.
(G) A permit shall not be sold, transferred, leased, assigned, or disposed of, in whole or in part, either by voluntary, involuntary, or forced sale, or by merger or consolidation or otherwise.
(H) If the permit holder, for any reason, is no longer able to provide the taxi service as applied for, the taxi service permit shall immediately terminate.
(I) All taxicabs operating within the corporate limits shall be prominently marked as such.

(A) Every person who transports passengers for a taxi service shall obtain a driver's permit from the chief. The chief will conduct an investigation to determine applicant's qualifications. Submission of an application for a driver's permit shall constitute a waiver of any privileges and rights of privacy with respect to any document in existence reasonably related to the determination of the applicant's qualifications and shall serve as an authorization to the chief to make inquiry of any person or entity, and to receive any oral or written reports from any person or entity, regarding any facts, evidence or information reasonably related to the determination of the applicant's qualifications. If needed, the applicant shall sign a separate written authorization for the release of documents or information concerning the applicant.
(B) No driver's permit shall be issued unless the applicant meets the following criteria:
(1) The applicant is at least 18 years of age or is otherwise legally emancipated and is a U.S. citizen or possesses documentation of eligibility to work in the United States;
(2) The applicant has not been convicted within the last ten years of any of the following:
(a) Any felony against the state or any offense against another state which would have been a felony if committed in North Carolina; and
(b) Any federal or state law relating to the use, possession, or sale of alcoholic beverages or narcotic or barbiturate drugs.
(3) The applicant has not been convicted within the last seven years of any of the following:
(a) Operation of a motor vehicle under the influence of intoxicants or narcotics or operating a motor vehicle after license has been suspended or revoked and before reinstatement.
(b) Violation of any of the provisions of G.S. § 14-204 in regard to prostitution or assignation.
(c) Assault with an automobile.
(d) Any three convictions of violating any traffic laws or regulations.
(C) If at any time a driver is criminally charged with any traffic or criminal violation, the driver shall notify chief within ten days of such violations.
(D) The driver's permit and driver's photograph shall be displayed in such a manner as to be in full view of all passengers at all times while the driver is on duty.
(E) Driver's permits are not transferable from one person to another. Driver's permits shall expire on June 30 of each year. Requests for renewal shall be made at least 30 days prior to the expiration date.

The chief may suspend or revoke any permit previously granted upon a showing that the taxi service or driver has violated any provision of this chapter. The chief shall notify the permittee in writing that a permit is suspended or revoked. Upon receipt of such notice, the permittee shall immediately suspend operations allowed under the permit. The permittee shall have ten days from the receipt of such notice to appeal the determination. Appeal will be filed with Town Manager. The Board shall conduct a hearing on the suspension and shall have final authority on suspension or revocation.

(A) Each taxi service and every driver shall pay to the town an annual fee in an amount as set from time to time by the board in its annual budget, said fees to be set in the schedule of fees adopted in conjunction with the annual budget ordinance.
(B) By resolution, the board shall establish fees for applications for taxi service permits and driver permits.
(C) Until changed by adoption of a new annual budget ordinance or by resolution of the board, the following fees shall be in effect:
(1) Taxi service application fee: $50
(2) Taxi service annual fee (privilege license): $15 per taxicab
(3) Taxicab driver permit application fee (exclusive of drivers listed on taxi service application: $25
(4) Taxicab driver permit annual fee: $3 per driver

All vehicles must pass the annual safety inspection required by the North Carolina Department of Motor Vehicles and be maintained in a manner that would meet the requirements established by that inspection. In addition, at any time, the chief shall have the right to inspect, approve or disapprove the various taxicabs and all equipment thereon operated in connection with the taxi service, and such inspections shall not be limited to the requirements of the annual Department of Motor Vehicles inspections. The chief shall have the right to order removal from service of any vehicle reasonably deemed to be a safety hazard.
