§ 93.05  VERMIN HARBORAGE.
   (A)   For the purpose of this section, the following definitions shall apply unless the context clearly indicates or requires a different meaning.
      HEALTH OFFICER.  The Town Marshal of the Town of South Whitley, Indiana or any officer working under his or her supervision.
      MOSQUITO HARBORAGE.  Any conditions or place conducive to mosquito breeding, primarily, but not exclusively, stagnate water or areas in which such water would tend to accumulate.
      OCCUPANT.  Any individual, over one year of age, living, sleeping, cooking, or eating in or having possession of a premises.
      OWNER.  Any one or more of the following:
         (a)   The owner or owners in fee simple of a parcel of real estate including the life tenant or tenants if any;
         (b)   The record owner or owners as reflected be the County Recorder’s office;
         (c)   The purchaser or purchasers of such real estate under any contract for the conditional sale thereof; or
         (d)   The person or person in control of the property as executor, executrix, trustee, receiver, or guardian of the owner.
      PREMISES.  A platted lot or part thereof or unplatted lot or parcel of land or plot of land, either occupied or unoccupied by any dwelling or nondwelling structure, and includes any such building, accessory structure, adjoining alley, easement, or drainage way.
      RAT HARBORAGE.  Any conditions or place where rats can or may live, nest, or seek shelter.
      SAFETY.  The condition of being reasonably free from danger and hazards which may cause accidents or disease, including, but not limited to, the absence of mosquito harborage and/or rat harborage.
   (B)   No buildings, vehicle, structure, receptacle, yard, lot, premises or part thereof, shall be construed, made, used, maintained, or operated in any manner causing or producing any health or safety hazard; or permitted to become a mosquito or rat harborage; or to become conducive to mosquito or rat harborage.
   (C)   No occupant or owner of a premises shall maintain rubbish, boxes, lumber, fire wood, scrap metal, junk vehicles, tires, or any other materials in such a manner that may provide a mosquito or rat harborage. Usable stored materials shall be stacked neatly; elevated at least 18 inches above the ground or floor; and arranged in such a manner as to not accumulate stagnate water.
   (D)   No owner or occupant of a premises shall store, place, or allow to accumulate any materials which may serve as food for rats in a site accessible to rats.
