If a person to whom an SESC permit is issued fails to complete the work or fails to comply with all the requirements, conditions and terms of the permit, the City Engineer may order such work as, in his or her opinion, is necessary to eliminate any dangerous conditions and to leave the site in a safe condition, or he or she may order the work authorized by the permit to be completed to a safe condition to his or her satisfaction. The permittee and the surety executing the bond or person making the cash deposit shall continue to be firmly bound under a continuing obligation for the payment of all necessary costs and expenses that may be incurred or expended by the City in causing any work to be done. In the case of a cash deposit, any unused portion thereof shall be refunded to the permittee only after the City Engineer certifies that the work has been satisfactorily done.
