(a) It shall be a violation of this section for any person, except as otherwise provided herein, to remove, cause to be removed, transplant or destroy a tree within the City without a tree permit issued in accordance with this section.
(b) A tree permit shall be required for the following, except as otherwise exempted under Section 1028.07.
(1) The removal, transplanting or destruction of any tree within a woodlands area. The removal, transplanting, topping or destruction of any tree of eight inches DBH or greater outside of a woodlands area.
(2) The removal, transplanting, topping or destruction of a landmark tree. Land clearing or grubbing within a woodlands area.
(3) The removal, transplanting, topping or destruction of any tree located within a public right-of-way, or on public property, subject only to the exception set forth in Section 1028.07(e) or as may be determined necessary by the City.
