818.22 FORCE MAJEURE: GRANTEE'S INABILITY TO PERFORM.
   A grantee shall not be held in default under, or in noncompliance with, the provisions of this chapter, nor suffer any enforcement or penalty relating to noncompliance or default (including termination, cancellation or revocation of the franchise), where such noncompliance or alleged default occurred or was caused by a strike, riot, war, earthquake, flood, tidal wave, unusually severe rainstorm, hurricane, other catastrophic act of nature, labor disputes or a governmental, administrative or judicial order or regulation, or any other event that is reasonably beyond a grantee's ability to anticipate and control. Force majeure also covers loss of utility service or facilities and work delays caused by waiting for utility providers to service or monitor their own utility poles on which a grantee's cable and/or equipment is attached.
