All heating, ventilating and air conditioning facilities in existing buildings, secondary and appurtenant structures shall be maintained in good condition to provide reasonable comfort and convenience for the occupants, and such facilities shall be installed and maintained so as to be free from any potential source of fire hazard or danger to the health, welfare and safety of the occupants.
The owner, agent, occupant or operator of a dwelling structure who rents or leases any dwelling unit therein under an agreement, express or implied, to supply or furnish heat to the occupants thereof shall have heating facilities capable of maintaining an average temperature of 68°F or 20°C in all habitable areas when the outdoor temperature is -5°F or -20°C without forcing the facilities to operate in excess of their design capacity.
