(a) Each filling station offering self-service shall be operated in accordance with National Fire Protection Association Standard No. 30 (1993), and the provisions of the Occupational Safety and Health Act of 1970, 84 Stat. 1590, 5 U.S.C.A. 5108, and any amendments thereto and standards adopted thereunder.
No person shall commence operation or public business of a self-service filling station without first obtaining an inspection business permit therefor, from the Bureau of Fire Prevention. Such inspection business permit shall be issued on an annual basis for each current year (January 1 through December 31) to any individual or corporate entity, doing business as a self-service filling station. The fee for such a permit shall be twenty-five dollars ($25.00) for each self-service dispensing gasoline refueling point located and/or operating on the premises. A refueling point shall be defined as the space or area where one vehicle at a time can normally be refueled. The Inspector of the Bureau of Fire Prevention shall be responsible for and authorized to issue the aforesaid permit after he or she or an officer designated by him or her from such Bureau has made a safety inspection of the premises and has found that the permit applicant has complied with all applicable State and City laws pertaining thereto.
The Inspector of the Bureau of Fire Prevention or an officer of such Bureau is authorized during regular business hours to make periodic inspections to assure that all pertinent State and City laws are currently complied with.
If, after an inspection at any such self-service filling station, the Bureau of Fire Prevention finds evidence of a violation of any applicable law, the aforesaid permit shall be suspended until the aforesaid violation(s) are corrected and an inspection thereof is made by the Bureau and approval given.
(b) The operation of the self-service filling station shall be in accordance with standards established in the Ohio Fire Code.
