(A) Mailboxes shall be installed at a minimum height of 42" above grade and a maximum of 48" above grade. The face of the box shall be a minimum of 12" and a maximum of 18" from the back of the curb, or if no curb is present, a minimum of 12" and a maximum of 18" from the edge of the pavement. Mailbox installation procedures shall follow the standards adopted by the United States Postal Service, as amended, and this code. In the event of a conflict between this code and the United States Postal Service’s standards, the more restrictive regulations shall apply. No mailbox shall be installed in the right-of-way without the owner first executing a waiver and release of liability on a form approved by the Village Attorney.
(B) Definitions. For the purpose of this section, the following definitions shall apply:
SPECIALTY MAILBOX. A mailbox that is constructed of a rigid or alternative material such as masonry, brick, block, decorative steel or other non-standard composite.
STANDARD MAILBOX. A 4-inch by 4-inch wooden post, meeting the standards for height and set-back as prescribed by the United States Postal Service and this code, with a plastic or aluminum containment box affixed to the top of post.
(C) Installation of a specialty mailbox shall require a permit from the village prior to installation, pursuant to the following procedures and conditions:
(1) An application for such permit shall be pursuant to the village’s standard application form and indicate the size, location and appearance of the specialty mailbox.
(2) If the Director determines, in his or her sole discretion, that the construction of a specialty mailbox poses a threat to surrounding public improvements, including, without limitation, utilities, streets and sidewalks, the Director may require the applicant to post a bond in accordance with § 50.04 of this code.
(3) The maximum base size of a specialty mailbox shall not exceed 3' x 3'.
(4) The maximum height of a specialty mailbox shall not exceed 5.5'.
(5) The specialty mailbox’s location shall not impose an undue burden on the surrounding public improvements, visibility or use of the surrounding sidewalks or rights of way, or otherwise pose a threat to or compromise the public health, safety and welfare.
(6) Before the village issues a permit, the owner shall execute a covenant on a form approved by the Village Attorney setting forth the owner’s responsibilities and liabilities, which shall be recorded against the owner’s property with the Kane County Recorder of Deeds.
(7) Issuance of a permit by the village shall not be construed to mean that the proposed specialty mailbox meets the standards of, or has been approved by, the United States Postal Service. Any relocation or replacement of a specialty mailbox required by the United States Postal Service shall be at the owner’s sole expense.
(D) The owner of the lot or parcel adjacent to the parkway shall be responsible for all costs associated with maintaining, replacing or relocating the mailbox located thereon.
