§ 90.03 PROHIBITED ACTS.
   (A)   It shall be unlawful:
      (1)   For the owner or any person who has in his or her custody or control, any dog, cat, or other animal to enter upon the premises of another within the village without the consent of the owner.
      (2)   To permit any animal, whether licensed or not, to enter any public body of water, pond, fountain or stream.
      (3)   To permit any animal to enter any place where food is stored, prepared, served or sold to the public, or any other public building or hall, provided however, that this section shall not apply to any blind or deaf person using a trained, seeing-eye dog, to veterinary offices or hospitals, or to animal shows or exhibitions.
      (4)   To permit any animal to damage, destroy any property, any thing of value or create a nuisance.
      (5)   To permit any dog, cat, or other animal to habitually snap, growl, snarl, jump upon, or otherwise threaten persons lawfully using any common thoroughfare, sidewalk, passageway, bypath, play area, park, or any place where people congregate or walk.
      (6)   To keep, harbor or maintain any vicious animal or animal with vicious propensities in a manner which may or does endanger the safety of persons or property off his or her premises or lawfully on his or her premises. Any dog or other animal that has previously demonstrated vicious propensities shall not be permitted upon a public street or highway, or upon any premises other than those of the person owning such dog or other animal unless such dog or other animal wears a muzzle securely fastened about its mouth in such a manner that it cannot bite, and is on a leash securely fastened to a collar or harness. The overall length of the leash including the handle shall not exceed six feet, and be held by its owner or other person able to control such dog or other animal and while lawfully on the premises of the owner, shall not be allowed to come in contact with any person who is not a member of the immediate household.
      (7)   To own, harbor, keep, or be in charge of any dog, cat, or other animal which has been declared a dangerous animal by the local health or police authorities.
      (8)   To permit any dog, cat, or other animal to howl, yelp, whine or meow, bark or make noise in such a manner as to disturb any person or neighborhood anytime of the day or night.
      (9)   To allow any place where any animal is or may be kept to become unclean or unsanitary or become offensive to those residing in the vicinity.
      (10)   To harbor or keep any live horse, cattle, swine, sheep, goat, or pigeons or to raise any chickens or fowl anywhere in the village. Exceptions are animals kept in agriculture zoning districts or as allowed under special use.
      (11) For any person to keep more than four dogs or cats, or any combination of dogs and cats not exceeding a total of four, on any one premise or within any single residence situated in the village. Said limitation shall not be applicable to regularly established, properly zoned, and licensed veterinary hospitals, pet shops, groomers, pounds, shelters, or kennels, nor shall kittens or puppies under the age of six months be counted for purposes of this limitation.
      (12) For any person in control of, causing or permitting any dog, cat, or other animal to be on any property, public or private, now owned or possessed by such person to fail to remove excrement left by such dog, cat or other animal to a proper receptacle located on property owned or possessed by such person.
      (13)   To fail to report an animal bite.
   (B)   No dog or other animal shall be permitted to run at large in the village any time. It shall be the duty of the owner or any other person who has in his or her custody or control a dog or other animal to keep the same safely and securely tied or confined at all times.
   (C)   It shall be unlawful for any person to keep, maintain or have in his or her possession or under his or her control within the village any duck, poisonous reptile, or any other dangerous or carnivorous wild animal or reptile, any vicious or dangerous domesticated animal or any other animal or reptile of wild, vicious or dangerous propensities except in zoological parks, performing animal exhibitions, educational institutions, veterinary hospitals or animal shelters.
   (D)   It shall be unlawful for any person to kill or wound, or attempt to kill or wound any squirrel or bird, or for any person to take the eggs or young of any bird within the limits of the village.
   (E)   No person shall cruelly treat any police dog of the village, and no person shall strike, tease, injure or kill any dog used by the Police Department of the village. No person shall interfere with any police dog while being used on police duties, and no person shall interfere with any police officer using a police dog on police duties.
   (F)   No person or owner shall kill, abandon, cruelly beat, torment, overload, overwork, or otherwise abuse animals in a manner to cause unnecessary suffering.
   (G)   No domestic animals or wildlife afflicted with a contagious or infectious disease shall be allowed in any public place; nor shall such diseased animal be shipped or removed from the premises of the owner thereof, except under the supervision of an authorized person.
   (H)   No owner shall fail to provide his or her animals with sufficient wholesome food and water, propershelter and protection from the weather, veterinary care when needed to prevent suffering and with humane care and treatment.
   (I)   No owner may abandon any animal where it may become a public charge or may suffer injury, hunger or exposure.
   (J)   No person shall leave any animal unattended in a motor vehicle or enclosed trailer when the outside temperature shall exceed 30 degrees Celsius (75 degrees Fahrenheit) or contain any animal in such manner that said animal does not have proper air circulation while confined in a motor vehicle, trailer, kennel, dog house, or any type of container or structure in which an animal may be confined.
   (K)   No person except an authorized person in the performance of his or her duties under this section shall remove a license tag from the collar of any dog or cat without the consent of the owner, nor shall any person attach a license tag to a dog or cat for which it is not licensed.
   (L)   No person shall hold a dog fight, cock fight or a greased pig contest.
   (M)   Diseases from the droppings of pigeons present a health hazard; therefore, harboring or keeping pigeons in the village is prohibited.
   (N)   Pursuant to ILCS Ch. 65, Act 5, § 11-20-9, it is expressly prohibited and made unlawful for any person to cause or permit any dog owned or kept by such person, to run at large. A dog shall be deemed to be running at large if such dog is not securely fastened and restrained by a leash, or otherwise restrained by a fence, and regardless of the fact of whether the dog is upon the property rented, owned, or possessed by such person, or not.
