(A) It is unlawful to operate trucks or other commercial vehicles which display, or are legally required to display, a Class "L" or higher license plate, as defined by the Illinois Vehicle Code, or any vehicle whose gross weight or whose gross vehicle weight rating (GVWR), or whose gross combination weight rating (GCWR), as those terms are defined in the Illinois Vehicle Code, exceeds thirty-two thousand (32,000) pounds on the following streets: Raymond Street/South Elgin Boulevard from the north village limits to East Middle Street; East Main Street from the east village limits to South Elgin Boulevard; East Middle Street from Eastview Street to Gilbert Street; Gilbert Street from Oak Street to the south village limits; East State Street from East Avenue to the Fox River Bridge; and Fulton Street from North Drive to East Plum Street.
(B) This section shall not apply to the following vehicles:
(1) Vehicles making local deliveries or service calls to or from a property located within the prohibited area, but then for not more than the minimum distance necessary for that purpose;
(2) Local vehicles otherwise legally parked or stored on property located within the prohibited area as permitted under the village zoning ordinance;
(3) Garbage pickup or refuse disposal services;
(4) School or passenger buses;
(5) Fire, police, or other emergency vehicles;
(6) Snowplowing and other maintenance vehicles of the village, or other public entity;
(7) Maintenance and service vehicles of Commonwealth Edison Company, Northern Illinois Gas Company, Illinois Bell Telephone Company, Ameritech and other utility or cable television or telecommunication providers; and
(8) Contractors and subcontractors of the village, including, without limitation, vehicles operated in conjunction with village public works projects.
(9) Towing service vehicles.
(C) For the purposes of this section, the prohibited area shall be defined as any area within the village limits, located east of the Fox River and west of the Illinois Prairie Path.
(D) The weight limitation set forth in § 71.02(A), as amended by Ordinance 2000-07, shall be reinstated to a Class “H” sixteen thousand (16,000) pound limitation if and when the Kane County regional bridge proposed to be constructed in South Elgin (Stearns Road corridor) is constructed and open for public vehicular traffic.
