§ 157.031 EXCEPTIONS.
   The provisions of §§ 157.030 through 157.039 shall not apply to:
   (A)   Agricultural land management and cultural practices, or to the construction of on-farm buildings and structures used in a farming operation, provided that the practices or structures do not materially impede the runoff capability of the existing major drainage channels or encroach upon a floodplain;
   (B)   Construction or land improvement of single-family residences or buildings accessory to the residences which are not a part of a residential subdivision subject to the Lexington County Subdivision Chapter, provided that the construction does not materially impede the runoff capability of the existing major drainage channels or encroach upon a floodplain;
   (C)   Land improvements to a single-family residence in a developed subdivision, provided that the construction does not materially impede the runoff capability of the existing major drainage channels or encroach upon a floodplain; or
   (D)   Mining and mineral resource extraction operations conducted in accordance with a valid mining permit issued by the Mining and Reclamation Division of the South Carolina Land Resources Conservation Commission, provided that the construction does not materially impede the runoff capability of the existing major drainage channels or encroach upon a floodplain.
